Financial Framework (Supplementary Powers) Regulations 1997                                             2

1  Name

                   This instrument is the Financial Framework (Supplementary Powers) Amendment (Prime Minister and Cabinet Measures No. 5) Regulations 2021.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note:          This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

             (2)  Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

                   This instrument is made under the Financial Framework (Supplementary Powers) Act 1997.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

1  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”)

Before “To provide”, insert:

Certain persons residing or employed in a COVID‑19 hotspot unable to earn usual income

2  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, subparagraph (c)(i) (first occurring))

Omit “of more than 7 days”.

3  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, paragraph (e) (first occurring))

Repeal the paragraph, substitute:

(e) have, or had, no available pandemic‑related paid leave entitlements to cover the period of the restrictions; and

4  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, paragraph (fa))

Repeal the paragraph.

5  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, at the end of paragraph (g) (first occurring))

Add:

 or (iii) pandemic payments from a State or Territory;

6  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”)

Before “In addition” (first occurring), insert:

Certain persons previously in a COVID‑19 hotspot unable to earn usual income

7  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, subparagraph (c)(i) (second occurring))

Omit “for a period of more than 7 days”.

8  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, paragraph (d) (second occurring))

Omit “of more than 7 days”.

9  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, paragraph (g) (second occurring))

Repeal the paragraph, substitute:

(g) have, or had, no available pandemic‑related paid leave entitlements to cover the period of the restrictions; and

10  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, paragraph (ha))

Repeal the paragraph.

11  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, at the end of paragraph (i))

Add:

or (iii) pandemic payments from a State or Territory;

12  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”)

Before “In addition” (second occurring), insert:

Certain persons residing or employed in State or Territory but outside COVID‑19 hotspot unable to earn usual income

13  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, subparagraph (c)(i) (third occurring))

Omit “(the hotspot public health order)”.

14  Part 4 of Schedule 1AB (table item 492, column headed “Objective(s)”, paragraphs (d) to (g) (third occurring))

Repeal the paragraphs, substitute:

(ca) at the particular time, do not reside and are not employed, or did not reside and were not employed, in a location determined by the Commonwealth Chief Medical Officer to be a COVID‑19 hotspot for the purposes of Commonwealth support; and

(d) are or were unable to earn their usual income as a direct or indirect result of the restrictions imposed by a public health order of the State or Territory; and

(e) have, or had, no available pandemic‑related paid leave entitlements to cover the period for which the financial assistance is provided; and

(f) make a declaration in relation to where they reside and are employed, or resided and were employed, during the period of the restrictions; and

(g) declare that they are or were unable to earn their usual income as a result of the restrictions imposed by a public health order of the State or Territory; and
