This instrument amends the Child Care Subsidy Minister’s Rules 2017 to ensure payments made by Victoria to providers for children participating in kindergarten programs in Victoria in 2021 do not reduce the hourly rate of child care subsidy that individuals are entitled to. This is a measure supporting child care providers and families in response to the COVID 19 pandemic.

1  Name

                   This instrument is the Child Care Subsidy Amendment (Coronavirus Response Measures No. 1) Minister’s Rules 2021.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

                   This instrument is made under the A New Tax System (Family Assistance) Act 1999.

Schedule 1Amendments

Child Care Subsidy Minister’s Rules 2017                   

1  Section 15C

Repeal the section.

2  Before subsection 16A(1)

Insert:

          (1A)  This section sets out payments that are prescribed for the purposes of paragraph 2(2A)(c) of Schedule 2 to the Family Assistance Act.

Note:          A payment prescribed in this section does not reduce the hourly session fee for a session of care, for the purposes of working out the hourly rate of CCS for that session.

3  Subsection 16A(1)

Omit “For paragraph 2(2A)(c) of Schedule 2 to the Family Assistance Act, a payment”, substitute “A payment”.

4  After subsection 16A(3)

Insert:

Payments for children in vulnerable or disadvantaged circumstances

          (3A)  A payment made by a State or Territory, or an authority of a State or Territory, to an approved provider is prescribed if:

                     (a)  it is for the purpose of enabling a child in vulnerable or disadvantaged circumstances to participate in early childhood education and care; and

                     (b)  it is made to reduce, wholly or in part, the liability of an individual or the individual’s partner to pay for a session of care provided to the child.

Payments for children to participate in a kindergarten program in Victoria

          (3B)  A payment made by Victoria to an approved provider is prescribed if:

                     (a)  it is for the purpose of enabling a child to participate in a kindergarten program in Victoria in 2021; and

                     (b)  it is made to reduce, wholly or in part, the liability of an individual or the individual’s partner to pay for a session of care provided to the child.

5  Subsection 16A(4)

Insert:

kindergarten program means an early childhood education program provided to children before their first year of school.
