1  Name

                   This instrument is the Higher Education Provider Amendment (Levy Waiver) Guidelines 2020.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note:          This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

             (2)  Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

                   This instrument is made under section 238-10 of the Higher Education Support Act 2003.

4  Schedule

                   The Higher Education Provider Guidelines 2012 are amended as set out in the Schedule to this instrument.

Schedule 1—Amendments

Higher Education Provider Guidelines 2012

1  After paragraph 2.10.5

Insert:

            2.10.5A   Paragraph 2.10.5 does not apply if the liability to pay the HELP                               tuition protection levy is waived under paragraph 2.10.45A.

2  After paragraph 2.10.15

Insert:

            2.10.15A   Paragraph 2.10.10 does not apply if the liability to pay the HELP                             tuition protection levy is waived under paragraph 2.10.45A.

3  Paragraph 2.10.40

            Omit “section”, substitute “paragraph”.           

4  After paragraph 2.10.45

Insert:

            Waiver of HELP tuition protection levy

2.10.45A   Payment of the HELP tuition protection levy is waived for all higher                        education providers for the calendar year 2020.
