1  Name

                   This instrument is the Industry Research and Development (Eat Seafood Australia Program) Instrument 2020.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

                   This instrument is made under section 33 of the Industry Research and Development Act 1986.

4  Definitions

                   In this instrument:

Act means the Industry Research and Development Act 1986.

program: see subsection 5(1).

5  Prescribed program

             (1)  For the purposes of subsection 33(1) of the Act, the Eat Seafood Australia Program (the program) is prescribed.

             (2)  The program provides funding in the form of a grant to Seafood Industry Australia Limited to deliver a 12‑month national marketing campaign that encourages domestic consumption of Australian seafood.

             (3)  The purpose of the program is to stimulate a boost in domestic demand for Australian seafood in order to:

                     (a)  support the seafood industry’s survival through the national crisis resulting from the coronavirus known as COVID‑19; and

                     (b)  bolster a strong, industry‑wide recovery as markets normalise.

6  Specified legislative power

                   For the purposes of subsection 33(3) of the Act, the powers of the Parliament to make laws with respect to the following are specified:

                     (a)  postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution);

                     (b)  enterprises and activities that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation.
