This instrument amends multiple instruments and modifies the Social Security Act 1991. It extends the period in respect of which the COVID-19 supplement will be paid. This instrument also reinstates the assets tests and the liquid assets test waiting period for certain payments. This instrument temporarily increases the income free area to $300 a fortnight for JobSeeker Payment recipients (except recipients who are both not a member of a couple and who are the principal carer of a child) and Youth Allowance (Other) recipients and increases the partner income taper rate for JobSeeker Payment recipients from 25 cents for every dollar over the partner income free area to 27 cents for every dollar over the partner income free area. This instrument also extends other measures put in place by the Social Security (Coronavirus Economic Response—2020 Measures No. 10) Determination 2020 to assist social security payment recipients impacted by COVID-19.

1  Name

                   This instrument is the Social Security (Coronavirus Economic Response—2020 Measures No. 14) Determination 2020.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

                   This instrument is made under the following:

                     (a)  section 504 of the Social Security Act 1991;

                     (b)  section 557 of the Social Security Act 1991;

                     (c)  section 646 of the Social Security Act 1991;

                     (d)  section 1210B of the Social Security Act 1991;

                     (e)  item 40A of Schedule 11 to the Coronavirus Economic Response Package Omnibus Act 2020.

4  Schedule 1—modifications

                   Each modification of the operation of a provision of a social security law (within the meaning of the Social Security Act 1991) as set out in Schedule 1 to this instrument is determined for the purposes of item 40A of Schedule 11 to the Coronavirus Economic Response Package Omnibus Act 2020.

5  Schedule 2—amendments

                   Each instrument that is specified in Schedule 2 to this instrument is amended or repealed as set out in the applicable items in that Schedule, and any other item in that Schedule has effect according to its terms.

Part 2COVID‑19 supplement

  

6  COVID‑19 supplement—parenting payment

             (1)  For the purposes of subsection 504(3) of the Social Security Act 1991, the initial period is extended by the period:

                     (a)  beginning on 25 September 2020; and

                     (b)  ending at the end of 18 December 2020.

             (2)  For the purposes of subsection 504(7) of the Social Security Act 1991, the amount of a person’s COVID‑19 supplement per fortnight for the extension period is:

                     (a)  in relation to an instalment period in relation to the person that began before 25 September 2020—$550; and

                     (b)  in relation to an instalment period in relation to the person that begins on or after 25 September 2020—$250.

7  COVID‑19 supplement—youth allowance

             (1)  For the purposes of subsection 557(3) of the Social Security Act 1991, the initial period is extended by the period:

                     (a)  beginning on 25 September 2020; and

                     (b)  ending at the end of 18 December 2020.

             (2)  For the purposes of subsection 557(7) of the Social Security Act 1991, the amount of a person’s COVID‑19 supplement per fortnight for the extension period is:

                     (a)  in relation to an instalment period in relation to the person that began before 25 September 2020—$550; and

                     (b)  in relation to an instalment period in relation to the person that begins on or after 25 September 2020—$250.

8  COVID‑19 supplement—jobseeker payment

             (1)  For the purposes of subsection 646(3) of the Social Security Act 1991, the initial period is extended by the period:

                     (a)  beginning on 25 September 2020; and

                     (b)  ending at the end of 18 December 2020.

             (2)  For the purposes of subsection 646(7) of the Social Security Act 1991, the amount of a person’s COVID‑19 supplement per fortnight for the extension period is:

                     (a)  in relation to an instalment period in relation to the person that began before 25 September 2020—$550; and

                     (b)  in relation to an instalment period in relation to the person that begins on or after 25 September 2020—$250.

Schedule 1Modifications of the Social Security Act 1991

  

1  Modification of section 500Q

Subsection 500Q(6) of the Social Security Act 1991 does not apply.

2  Modification of section 547B

Subsection 547B(2) of the Social Security Act 1991 does not apply.

3  Modification of section 611

Subsection 611(3) of the Social Security Act 1991 does not apply.

4  Modification of point 1067G-H1         

Point 1067G-H1 of the Social Security Act 1991 is varied by omitting “and 1067G‑H33” in step 6 of the method statement and substituting “, 1067G‑H33 and 1067G‑H34”.

5  Modification of point 1067G‑H29

Paragraph 1067G‑H29(b) of the Social Security Act 1991 is varied by omitting “$143” and substituting “$300”.

6  Modification of point 1067G‑H31

Point 1067G‑H31 of the Social Security Act 1991 is varied by omitting “If” and substituting “Subject to point 1067G‑H34, if”.

7  Modification of point 1067G‑H32

(1)       Paragraph 1067G‑H32(b) of the Social Security Act 1991 is varied by omitting “$80; or” and substituting “$80.”.

(2)       Point 1067G‑H32 of the Social Security Act 1991 is varied by omitting paragraph (c).

8  Modification of point 1067G‑H33

(1)       Paragraph 1067G‑H33(b) of the Social Security Act 1991 is varied by omitting “$80; or” and substituting “$80.”.

(2)       Point 1067G‑H33 of the Social Security Act 1991 is varied by omitting paragraph (c).

9  Modification of Module H of the Youth Allowance Rate Calculator in section 1067G

Module H of the Youth Allowance Rate Calculator in section 1067G of the Social Security Act 1991 is varied by adding the following point at the end of the Module:

Ordinary income reduction if paragraph 1067G‑H29(b) applies

1067G‑H34     If paragraph 1067G‑H29(b) applies to a person, the person’s ordinary income reduction is an amount equal to 60% of the person’s ordinary income excess.

10  Modification of point 1068‑G1

Point 1068‑G1 of the Social Security Act 1991 is varied by omitting “and 1068‑G17” in step 10 of the method statement and substituting “, 1068‑G16A and 1068‑G17”.

11  Modification of point 1068‑G12

Point 1068‑G12 of the Social Security Act 1991 is varied by omitting the point (including the notes) and substituting:

Ordinary income free area

1068‑G12  In working out the rate of partner allowance or widow allowance, a person’s ordinary income free area is $106. In working out the rate of jobseeker payment, a person’s ordinary income free area is:

                     (a)  $300, unless paragraph (b) applies; or

                     (b)  if the person is not a member of a couple and is the principal carer of a child—$106.

12  Modification of point 1068‑G14

Point 1068‑G14 of the Social Security Act 1991 is varied by omitting “point 1068‑G17” and substituting “points 1068‑G16A and 1068‑G17”.

13  Modification of Module G of Benefit Rate Calculator B in section 1068

Module G of Benefit Rate Calculator B in section 1068 of the Social Security Act 1991 is varied by inserting the following point after point 1068‑G16:

Ordinary income reduction for recipients of jobseeker payment

1068‑G16A     Subject to point 1068‑G17, if a person has an ordinary income excess and is receiving jobseeker payment, the person’s ordinary income reduction is an amount equal to 60% of the person’s ordinary income excess.

14  Modification of point 1068‑G17

Point 1068‑G17 of the Social Security Act 1991 is varied by omitting the heading to the point.

1  Item 5 of Schedule 1

Omit all the words after “waiting period”, substitute “if:

                     (a)  any part of that period occurs during the period starting on 25 March 2020 and ending on 24 September 2020; and

                     (b)  the person claims youth allowance on or before 24 September 2020.

2  Item 10 of Schedule 1

Omit all the words after “waiting period”, substitute “if:

                     (a)  any part of that period occurs during the period starting on 25 March 2020 and ending on 24 September 2020; and

                     (b)  the person claims austudy payment on or before 24 September 2020.

3  Item 14 of Schedule 1

Omit all the words after “waiting period”, substitute “if:

                     (a)  any part of that period occurs during the period starting on 25 March 2020 and ending on 24 September 2020; and

                     (b)  the person claims a jobseeker payment on or before 24 September 2020.

Repeal the subsection, substitute:

             (3)  For the purposes of paragraph 1210B(1)(d) of the Social Security Act 1991, the fortnightly amount of a person’s COVID‑19 supplement for the period is:

                     (a)  in relation to an instalment period in relation to the person that began before 25 September 2020—$550; and

                     (b)  in relation to an instalment period in relation to the person that begins on or after 25 September 2020—$250.
