This instrument repeals and replaces the National Disability Insurance Scheme (Specialist Disability Accommodation) Rules 2016, while also making several amendments, including those that give effect to a Council of Australian Governments’ Disability Reform Council commitment to implement the recommendations of the 2018 Review of the Specialist Disability Accommodation Pricing and Payment Framework. The purpose of repealing and replacing the existing rules is to bring the rules into line with regulatory best practice, and to refine and rationalise the instrument in accordance with best practice drafting standards. Further amendments have been drafted to remove limits upon occupancy of Specialist Disability Accommodation in order to provide support that is more flexible for families, and make other technical amendments.
