Determinations/Health as made
This instrument declares the current COVID-19 pandemic as a situation of emergency for the purposes of subsection 42-2A(1) of the Aged Care Act 1997. Under this determination, emergency leave will be available to permanent aged care residents across Australia from 1 April 2020 to 30 September 2020.

1  Name

                   This instrument is the Aged Care (Leave from Residential Care Services) (Situation of Emergency—Human Coronavirus with Pandemic Potential) Determination 2020.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

4  Situation of emergency—human coronavirus with pandemic potential

                   There is a situation of emergency for all days in the period beginning on 1 April 2020 and ending on 30 September 2020 for all residential care services in Australia.
