These regulations amend the Financial Framework (Supplementary Powers) Regulations 1997 to establish legislative authority for the government to provide supplementary one-off payments to eligible families under the Australian Government Disaster Recovery Payment who are adversely affected by the bushfires. The Department of Home Affairs has policy responsibility for this spending activity.

1  Name

                   This instrument is the Financial Framework (Supplementary Powers) Amendment (Home Affairs Measures No. 1) Regulations 2020.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

                   This instrument is made under the Financial Framework (Supplementary Powers) Act 1997.

Support to communities affected by bushfires—payments for children

To provide, as child endowment or family allowances within the meaning of paragraph 51(xxiiiA) of the Constitution, one‑off payments in relation to bushfires to:

(a) persons who are eligible, in relation to the bushfires, for an amount of Australian Government Disaster Recovery Payment under the Social Security Act 1991 that includes the child rate; and

(b) citizens of New Zealand who hold special category visas and who are eligible, in relation to the bushfires, for Commonwealth ex‑gratia assistance that includes an amount in respect of a child or children.
