This instrument amends the Imported Food Control Order 2019 to classify pure and highly concentrated caffeine products as risk foods, so that these foods can be targeted for inspection to verify compliance with proposed new limits in the Australia New Zealand Food Standards (the Code) for caffeine in foods to protect public health and safety.

1  Name

                   This instrument is the Imported Food Control Amendment (Pure and Highly Concentrated Caffeine Products) Order 2019.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

                   This instrument is made under section 10 of the Imported Food Control Regulations 2019.

Omit “regulation 10”, substitute “section 10”.

2  Clause 1 of Schedule 1 (at the end of the table)

Add:

Food in which caffeine is present at a concentration of:

(a) 5% or greater, if the food is a solid or semi‑solid food; or

(b) 1% or greater, if the food is a liquid food.
