This instrument amends paragraph 6(2)(b) of the Radiocommunications Licence Conditions (Apparatus Licence) Determination 2015 to make it clearer that mobile stations that are not covered by the Radiocommunications (Electromagnetic Radiation – Human Exposure) Standard 2014 are required to comply with Part 3 of the determination.

1  Name

                   This is the Radiocommunications Licence Conditions (Apparatus Licence) Amendment Determination 2019 (No. 1).

2  Commencement

                   This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

3  Authority

                   This instrument is made under paragraph 107(1)(f) of the Radiocommunications Act 1992.

4  Amendments

                   The instrument that is specified in Schedule 1 is amended as set out in the applicable items in that Schedule.

 


Schedule 1—Amendments

Radiocommunications Licence Conditions (Apparatus Licence) Determination 2015 (F2015L00210)

1  Paragraph 6(2)(b)

Omit “mobile station that complies with the Radiocommunications (Electromagnetic Radiation—Human Exposure) Standard 2014”, substitute “compliant mobile station”.

2  After paragraph 6(2)(b)

Insert:

(c)        For the purpose of paragraph (b), compliant mobile station means a mobile station:

(i)          to which the Radiocommunications (Electromagnetic Radiation — Human Exposure) Standard 2014 applies; and

(ii)         that complies with that standard.
