This instrument amends the Norfolk Island Continued Laws Ordinance 2015 with the effect of amending the Land Valuation Act 2012 to improve its operation. The primary change is removal of the requirement for an objection conference to be held before an objection to a valuation can be taken to the Administrative Appeals Tribunal.

1  Name

                   This Ordinance is the Norfolk Island Continued Laws Amendment (Land Valuation) Ordinance 2019.

2  Commencement

             (1)  Each provision of this Ordinance specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

                   This Ordinance is made under section 19A of the Norfolk Island Act 1979.

4  Schedules

                   Each instrument that is specified in a Schedule to this Ordinance is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Ordinance has effect according to its terms.

1  Before item 192 of Schedule 1

Insert:

191C  At the end of subsection 23(1)

Add “However, the valuer‑general is not required to make available the owner’s name and address for service under this Act.”.

191D  Subsection 24(1)

After “Valuation roll information”, insert “(except for the owner’s name and address for service under this Act)”.

191E  Subsection 24(2)

Omit “section 38(1)”, substitute “section 25(1)”.

191F  Subsection 24(2) (note)

Repeal the note.

191G  Subsection 25(1)

After “after making a valuation”, insert “mentioned in paragraph 21(a) or (b)”.

191H  Section 28 (heading)

Omit “division one”, substitute “this Part”.

191K  Paragraph 39(1)(c)

Repeal the paragraph, substitute:

                     (c)  the Registrar of Titles has amended the valuation roll to record the change of ownership.

Repeal the paragraph, substitute:

                     (a)  whether or not the information is the subject of an invitation under section 64(2); and

Before “the valuation”, insert “if the objection stated a particular valuation that the objector sought—“.

2  After item 193 of Schedule 1

Insert:

193AA  Section 101

After “a particular valuation”, insert “, except for the owner’s name and address for service under this Act,”.

193AB  Subsection 103(1)

Repeal the subsection.

193AC  Subsection 106(5) (definition of change‑of‑ownership information)

Omit “from the most recent ownership change notice for”, substitute “about the most recent change of ownership of”.

193AD  Subsection 110(1)

Omit “(1)”.

Repeal the subsection.

Repeal the subsection.
