CASA 89/19 — Number of Cabin Attendants (Network Aviation Pty Ltd) Direction 2019

1          Name

                 This instrument is CASA 89/19 — Number of Cabin Attendants (Network Aviation Pty Ltd) Direction 2019.

2          Duration

                 This instrument:

(a)   commences on the day after it is registered; and

(b)   is repealed at the earlier of the following:

             (i)  the commencement of the Civil Aviation Safety Amendment (Part 121) Regulations 2018;

            (ii)  the end of 30 September 2021.

Note   For regulation 11.250 of CASR, the directions issued in this instrument cease to be in force at the earlier of the times mentioned in paragraph (b).

3          Repeal of instrument CASA 81/18

CASA 81/18 — Number of Cabin Attendants (Network Aviation) Direction 2018 is repealed.

4          Definitions

                 In this instrument:

cabin attendant: see subsection 2 of Civil Aviation Order 20.16.3.

Network Aviation means Network Aviation Pty Ltd, ARN 555309.

relevant aircraft means:

(a)   the Airbus A320 series aircraft that have the certified maximum passenger seating capacity of 180 passengers, and corresponding cabin configuration, mentioned in the type certificate data sheet for the aircraft; or

(b)   the Fokker F28 MK 0100 series aircraft that have the certified maximum passenger seating capacity of 109 passengers, and corresponding cabin configuration, mentioned in the type certificate data sheet for the aircraft.

relevant type certificate data sheet means the type certificate data sheet, for the relevant aircraft, as it exists at the commencement of this instrument.

5          Application

         This instrument applies to Network Aviation in relation to its operation of the relevant aircraft in charter, or regular public transport, operations.

6          Directions

        (1)     Subparagraph 6.1 (b) of Civil Aviation Order 20.16.3 does not apply to Network Aviation.

        (2)     Network Aviation must assign for duty at least 1 cabin attendant for each unit of 50 passengers or less carried on a flight of the relevant aircraft.

        (3)     Network Aviation must give written notice to CASA of any proposed revision of any part of Network Aviation’s operations manual that relates to emergency procedures for the relevant aircraft, including in relation to exits.

        (4)     A notice mentioned in subsection (3) must be given at least 14 days before making the proposed revision.
