1          Name

                 This instrument is CASA 29/19 — Dropping of Articles from Certain Aircraft Towing Another Aircraft Direction 2019.

2          Duration

                 This instrument:

(a)   commences on 1 May 2019; and

(b)   is repealed at the end of 30 April 2022.

3          Definitions

Note   In this instrument, certain terms and expressions have the same meaning as they have in the Act and the Regulations, including flight manual, which is defined in clause 37 of Part 2 of the CASR Dictionary.

                 In this instrument:

CAO 95.32 means Civil Aviation Order 95.32, as in force from time to time.

CAO 95.55 means Civil Aviation Order 95.55, as in force from time to time.

HGFA means Hang Gliding Federation of Australia Inc, ARN 217853.

HGFA Operations Manual has the same meaning as in paragraph 2.1 of CAO 95.32.

RAAus means Recreational Aviation Australia Limited, ARN 224806.

RAAus Operations Manual has the same meaning as RAA Operations Manual in paragraph 2.1 of CAO 95.55.

relevant aircraft means an aeroplane:

(a)   that is registered with RAAus or HGFA; and

(b)   to which CAO 95.32 or CAO 95.55 applies.

relevant Operations Manual means:

(a)   for a relevant aircraft that is registered with RAAus — the RAAus Operations Manual; and

(b)   for a relevant aircraft that is registered with HGFA — the HGFA Operations Manual.

4          Application

                 This instrument applies in relation to a relevant aircraft:

(a)   that is used to tow another aircraft; and

(b)   from which ropes or associated fittings used for towing the other aircraft are dropped.

5          Directions

                 For subparagraph 150 (2) (a) (viii) of CAR, the pilot in command of a relevant aircraft that is used to tow another aircraft must:

(a)   satisfy all eligibility and competency requirements for the towing of the other aircraft that are mentioned in the relevant Operations Manual; and

(b)   ensure the towing of the other aircraft is conducted in accordance with the relevant Operations Manual; and

(c)   ensure the other aircraft is operated in accordance with any requirements for towing of the other aircraft that are mentioned in the other aircraft’s flight manual; and

Note   The pilot in command must also comply with a requirement, instruction, procedure or limitation concerning the operation of the relevant aircraft that is set out in the aircraft’s flight manual — see subregulation 138 (1) of CAR.

(d)   take reasonable steps to avoid any person or animal being injured, or property being damaged, from the dropping of ropes or associated fittings used for towing the other aircraft.
