This instrument determines the total allowable catch for each quota species in each sub-area of the Small Pelagic Fishery for the purposes of section 17 of the Small Pelagic Fishery Management Plan 2009, for the 2019-20 fishing season.

Small Pelagic Fishery (Total Allowable Catch) Determination 2019

The Australian Fisheries Management Authority makes the following determination in accordance with a decision made by the Commissioners under section 23 of the Fisheries Administration Act 1991

1  Name

                   This instrument is the Small Pelagic Fishery (Total Allowable Catch) Determination 2019.

2  Commencement

                   This instrument commences on the day after it is registered on the Federal Register of Legislation.

3  Authority

                   This instrument is made pursuant to subsection 17(6)(aa) of the Act for the purpose of subsection 17(1) of the Management Plan.

4  Definitions

             (1)  In this instrument:

Act means the Fisheries Management Act 1991.

Management Plan means the Small Pelagic Fishery Management Plan 2009

             (2)  A term used in this instrument that is defined for the purposes of the Plan has the same meaning in this instrument as it has in that Plan.

Note:          Terms defined in the Fisheries Management Act 1991 have the same meaning in this instrument (see paragraph 13(1)(b) of the Legislation Act 2003). 

5  Determination of total allowable catch

             (1)  For a species of fish specified in an item in column 1 of the table within the sub-area of fishery specified in column 2 of the table the total allowable catch, in tonnes, for that species in that sub-area is determined in column 3.
