This instrument amends the Superannuation (CSS) (Eligible Employees – Exclusion) Declaration 2003 to specify the circumstances in which Australian Securities and Investments Commission (ASIC) staff who continue to be members of the Commonwealth Superannuation Scheme (CSS) upon transferring from Commonwealth employment to direct employment by ASIC on 1 July 2019 cease CSS membership.

1  Name

                   This instrument is the Superannuation (CSS) (Eligible Employees – Exclusion) Amendment Declaration 2019 (No. 1).

2  Commencement

                   This instrument commences on 1 July 2019.

3  Authority

                   This instrument is made under paragraph (j) of the definition of eligible employee in subsection 3(1) of the Superannuation Act 1976.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Superannuation (CSS) (Eligible Employees – Exclusion) Declaration 2003

1  Subsection 3(1) of Part 1 (after the definition of ARPC)

Insert the following new definition:

ASIC means the Australian Securities and Investments Commission established by the Australian Securities and Investments Commission Act 1989 and continued in existence by the Australian Securities and Investments Commission Act 2001.

2  Schedule 1 (after table item 26)

Insert:

A person who becomes an eligible employee under paragraph 4(2)(s) of the Inclusion Declaration

The person ceases to be an employee of ASIC

The end of the day on which the person ceases to be an employee of ASIC

The person becomes a casual or temporary part-time employee of ASIC

The end of the day immediately before the day on which the person becomes a casual or temporary part-time employee of ASIC

ASIC ceases to be a Commonwealth entity for the purposes of the Public Governance, Performance and Accountability Act 2013

The end of the last day on which ASIC is a Commonwealth entity
