Indian Ocean Territories Administration Values and Code of Conduct 2018

I, Karly Pidgeon, General Manager of the Indian Ocean Territories Branch, a delegate of the Minister for Regional Development, Territories, and Local Government for the purposes of subsection 11(1) of the Administration Ordinance 1968 (CI) and paragraph 10(1)(b) of the Administration Ordinance 1975 (CKI) make the following determination.

1  Name

                   This determination is the Indian Ocean Territories Administration Values and Code of Conduct 2018.

2  Commencement

(1) This determination commences on 3 April 2018.

(2) The Christmas Island Administration Determination 2001/2 is revoked.

3  Authority

This determination is made under subsection 11(1) of the Administration Ordinance 1968 (CI) and paragraph 10(1)(b) of the Administration Ordinance 1975 (CKI).

Interpretation

                   In this notice:

Administration means the Indian Ocean Territories Administration.

Administration employee means a person employed under:

(i)                 subsection 11(1) of the Administration Ordinance 1968 (CI);

(ii)               paragraph 10(1)(a) of the Administration Ordinance 1975 (CKI)

Indian Ocean Territories Administration Values means the values in Schedule 1.

Indian Ocean Territories Administration Code of Conduct means the rules in Schedule 2.

6  Application

This determination applies to all Administration employees.

7  Term of Employment

All employees are required to uphold the Indian Ocean Territories Administration Values and Code of Conduct 2018.

Schedule 1—Indian Ocean Territories Administration Values

 

Committed to service

(a)           The Administration is professional, objective, innovative and efficient, and works collaboratively to achieve the best results for the Australian community and the Government.

Ethical

(b)          The Administration demonstrates leadership, is trustworthy, and acts with integrity, in all that it does.

Respectful

(c)           The Administration respects all people, including their rights and their heritage.

Accountable

(d)          The Administration is open and accountable to the Australian community under the law and within the framework of Ministerial responsibility.

Impartial

(e)           The Administration is apolitical and provides the Government with advice that is frank, honest, timely and based on the best available evidence.


 

Schedule 2—Indian Ocean Territories Administration Code of Conduct

 

1                    An Administration employee must behave honestly and with integrity in connection with Administration employment.

2                    An Administration employee must act with care and diligence in connection with Administration employment.

3                    An Administration employee, when acting in connection with Administration employment, must treat everyone with respect and courtesy, and without harassment.

4                    An Administration employee when acting in connection with Administration employment, must comply with all applicable Australian laws. For this purpose, Australian law means:

(a)           any act, or any instrument made under an Act; or

(b)          any law of a State or Territory, including any instrument made under such a law.

5                    An Administration employee must comply with any lawful and reasonable direction given by someone in the Administration who has authority to give the direction.

6                    An Administration employee must maintain appropriate confidentiality about dealing that the employee has with any Minister or Minister’s member of staff.

7                    An Administration employee must disclose, and take reasonable steps to avoid, any conflict of interest (real or apparent) in connection with their Administration employment.

8                    An Administration employee must use Commonwealth resources in a proper manner.

9                    An Administration employee must not provide false or misleading information in response to a request for information that is made for official purposes in connection with the employee’s Administration employment.

10                An Administration employee must not make improper use of:

(a)           inside information; or

(b)          the employee’s duties, status, power or authority;

in order to gain, or seek to gain, a benefit or advantage for the employee or any other person.

11                An Administration employee must at all times behave in a way that upholds:

(a)           the Indian Ocean Territories Administration Values; and

(b)           the integrity and good reputation of the Administration.

12                An Administration employee while on duty overseas must at all times behave in a way that upholds the good reputation of Australia.

13                An Administration employee must comply with any other conduct requirement issued by the Minister.
