Part 1Preliminary

1  Name

                   This instrument is the Telecommunications (Carrier Licence Exemption - NSW Telco Authority) Determination 2018.

2  Commencement

                   This instrument commences on the day after it is registered on the Federal Register of Legislation.

3  Authority

                   This instrument is made under paragraph 51(1)(c) and subsection 51(2) of the Telecommunications Act 1997.

4  Cessation

                   This instrument ceases to have effect on the third anniversary of the day this instrument commences.

5  Definitions

Note:          A number of expressions used in this determination are defined in the Act, including the following:

(a)      designated radiocommunications facilities;

(b)      line link; and

(c)      network unit.

                   In this instrument:

ABN means Australian Business Number.

ACN means Australian Company Number.

Act means the Telecommunications Act 1997.

designated Government Radio Network communications infrastructure means one or more network units that:

(a)           are owned or otherwise vested in the NSW Telco Authority in accordance with the Government Telecommunications Act 2018 (NSW); and

(b)          are comprised of line links and designated radiocommunications facilities; and

(c)           subject to section 7(1)(a), do not utilise any radio communications technology that would have the effect of substantially altering the technical capability (as that capability stood as at the day this instrument is made) of any one or more of the network units;

(d)          are used to supply trunked radio communications; and

(e)           are situated in:

(i)           the State of New South Wales; or

(ii)         the State of Queensland; or

(iii)       the State of South Australia; or

(iv)       the State of Victoria; or

(v)         the Australian Capital Territory; and

(f)           are in existence at any time during the three year period commencing from the day this instrument is made.

NSW Telco Authority means the New South Wales Government Telecommunications Authority established by the Government Telecommunications Act 2018 (NSW).

Permitted Purpose means any voice or data communications necessary or desirable to perform, support or facilitate:

(a)public safety activities; or

(b)     public safety functions.

Permitted User means:

                     (a)  a department, agency, authority, institution or instrumentality of the Commonwealth of Australia; or

                     (b)  a department, agency, authority, institution or instrumentality (including of local government) of the State of New South Wales; or

                     (c)  a corporation owned wholly by the State of New South Wales; or

                     (d)  an entity specified by Schedule 1, even if its name is later changed.

 

                  radio communications technology includes, but is not limited to, any of the

      following technology types:

(i)           Global System for Mobile Communications (GSM);

(ii)         Code Division Multiple Access (CDMA);

(iii)       Universal Mobile Telecommunications System (UMTS);

(iv)       Long Term Evolution (LTE);

(v)         Wireless Fidelity (Wi Fi);

(vi)       Microwave other than for point to point connectivity; or

(vii)           Fifth generation cellular mobile communications (5G);or

(viii)         Fifth generation New Radio (5G NR);

(ix)       Bluetooth.

 

Part 2—Exemption and conditions

6  Exemption

                   Subject to the conditions set out in section 7 of this instrument, section 42 of the Act does not apply in relation to the use of the designated Government Radio Network communications infrastructure for the purpose of supplying one or more carriage services to:

(a)    Permitted Users for a Permitted Purpose; or

(b)   any person so that the person can prepare for or deal with an emergency or natural disaster.  

7  Conditions

(1)For the purposes of section 6 of this instrument, the following conditions are specified:

(a)    the use of Long Term Evolution (LTE), Wireless Fidelity (Wi Fi) or Microwave technologies in the designated Government Radio Network communications infrastructure occurs only to the extent that such use is necessary for the NSW Telco Authority to provide point-to-point connectivity; and

 

(b)   NSW Telco Authority must provide to the Australian Communications and Media Authority (ACMA) within 30 days from the commencement of this instrument (commencement date), a written report from the NSW Telco Authority’s Managing Director setting out the following:

(i)      the locations of the network units comprising the designated Government Radio Network communications infrastructure as at commencement date;

(ii)    the legal name and associated identifier (such as an ABN or ACN) of each user of the designated Government Radio Network communications infrastructure as at the close of business on the commencement date; and

(iii)  the technology composition of each of the network units as at the commencement date; and

(c)    NSW Telco Authority must provide to the ACMA within 30 days after the end of each calendar year during which this instrument is in force, a written report from the NSW Telco Authority’s Managing Director setting out the following:

(i)     the locations of the network units comprising the designated Government Radio Network communications infrastructure as at the end of the calendar year to which the report relates; and

(ii)   the legal name and associated identifier (such as an ABN or ACN) of each user of the designated Government Radio Network communications infrastructure as at the end of the calendar year to which the report relates; and

(iii)  the particulars of any substantial changes (technological or otherwise), made to the designated Government Radio Network communications infrastructure or its composition at any time during the calendar year to which the report relates.

(e) Chevra Hatzollah Sydney Inc (ABN 22 742 478 216);

(f) Endeavour Energy (ABN 59 253 130 878);

(g) Essential Energy (ABN 37 428 185 226);

(h) Harbour City Ferries Pty Ltd (ABN 57 156 137 236.);

(i) Maritime Rescue NSW (ABN 98 138 078 092);
