1  Name

                   This instrument is the Australian Radiation Protection and Nuclear Safety (Repeal and Consequential Amendments) Regulations 2018.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note:          This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

             (2)  Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

                   This instrument is made under the following:

                     (a)  the Australian Radiation Protection and Nuclear Safety Act 1998;

                     (b)  the Environment Protection and Biodiversity Conservation Act 1999.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Part 1—Repeals

Australian Radiation Protection and Nuclear Safety Regulations 1999

1  The whole of the instrument

Repeal the instrument.

Part 2—Amendments

Environment Protection and Biodiversity Conservation Regulations 2000

2  Paragraph 2.02(1)(a)

Omit “activity mentioned for the nuclide in column 4 of Part 2 of Schedule 2 to the ARPNS Regulations”, substitute “activity value for the nuclide set out in Part 1 of Schedule 1 to the Australian Radiation Protection and Nuclear Safety Regulations 2018”.

3  Paragraph 2.02(1)(b)

Omit “are unsealed sources—10⁶ times the activity mentioned in column 4 of Part 2 of Schedule 2 to the ARPNS Regulations for the nuclide at or above the activity concentration mentioned in column 3 of Part 2 of that Schedule for the nuclide”, substitute “at or above the activity concentration value mentioned for the nuclide in Part 1 of Schedule 1 to the Australian Radiation Protection and Nuclear Safety Regulations 2018 are unsealed sources—10⁶ times the activity value for the nuclide set out in that Part”.

4  Subregulation 2.02(3) (definition of sealed source activity value)

Omit “activity mentioned in column 4 of Part 2 of Schedule 2 to the ARPNS Regulations for the nuclide”, substitute “activity value for the nuclide set out in Part 1 of Schedule 1 to the Australian Radiation Protection and Nuclear Safety Regulations 2018”.

5  Subregulation 2.02(3) (definition of unsealed source activity concentration value)

Omit “activity concentration mentioned in column 3 of Part 2 of Schedule 2 to the ARPNS Regulations for the nuclide”, substitute “activity concentration value for the nuclide set out in Part 1 of Schedule 1 to the Australian Radiation Protection and Nuclear Safety Regulations 2018”.

6  Subregulation 2.02(3) (definition of unsealed source activity value)

Omit “activity mentioned in column 4 of Part 2 of Schedule 2 to the ARPNS Regulations for the nuclide”, substitute “activity value for the nuclide set out in Part 1 of Schedule 1 to the Australian Radiation Protection and Nuclear Safety Regulations 2018”.
