These regulations amend the Offshore Petroleum and Greenhouse Gas Storage (Regulatory Levies) Regulations 2004 to implement the outcomes of a recent review of the National Offshore Petroleum Safety and Environmental Management Authority's cost recovery implementation statement, which proposed increased levy amounts for safety case levies, annual well levies, well activity levies and environment plan levies.

1  Name

                   This instrument is the Offshore Petroleum and Greenhouse Gas Storage (Regulatory Levies) Amendment Regulations 2018.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

                   This instrument is made under the Offshore Petroleum and Greenhouse Gas Storage (Regulatory Levies) Act 2003.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

  

Offshore Petroleum and Greenhouse Gas Storage (Regulatory Levies) Regulations 2004

1  Regulation 49

Repeal the regulation, substitute:

49  Amount of annual well levy

                   For the purposes of subsection 10A(4) of the Regulatory Levies Act, the amount of annual well levy is $4,540 per eligible well in relation to the petroleum title for the year.

2  Regulation 52

Repeal the regulation, substitute:

52  Amount of annual well levy

                   For the purposes of subsection 10B(4) of the Regulatory Levies Act, the amount of annual well levy is $4,540 per eligible well in relation to the State/Territory petroleum title for the year.

3  Regulation 55

Omit “For subsection 10C(4) of the Regulatory Levies Act”, substitute “For the purposes of subsection 10C(4) of the Regulatory Levies Act”.

4  Regulation 55 (table item 1, column headed “Amount”)

Omit “$35 000”, substitute “$38,500”.

5  Regulation 58

Omit “For subsection 10D(4) of the Regulatory Levies Act”, substitute “For the purposes of subsection 10D(4) of the Regulatory Levies Act”.
