1  Name

This is the Variation to Licence Area Plan – Coffs Harbour Radio – 2018 (No.1).

2  Commencement

                   This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

Note:    The Federal Register of Legislation may be accessed at www.legislation.gov.au.

3  Authority

                   This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.

4  Variation

                   The Licence Area Plan – Coffs Harbour (Radio) – October 1998 (F2005B00592) is varied as follows:

(a)      rename the instrument as the “Licence Area Plan – Coffs Harbour Radio”;

(b)     on the title page, omit the heading “Licence Area Plan – Coffs Harbour (Radio)”, substitute “Licence Area Plan – Coffs Harbour Radio”;

(c)      on page 3:

(i)         immediately before paragraph (1), omit the heading “DETERMINATION”;

(ii)       omit each occurrence of the word “Determination” in paragraphs (1) to (5) and substitute with the word “plan”;

(iii)     omit paragraph (6) and substitute the following paragraph:

 

(6)   In this plan, unless the contrary intention appears:

(a)           a reference in this plan to a schedule or an attachment is a reference to a schedule or an attachment to this plan;

(b)          a reference to the Broadcasting Services (Technical Planning) Guidelines 2017 is a reference to that instrument as in force from time to time;

(c)           a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and

(d)          a reference to any other kind of instrument or writing is a reference to that other kind of instrument or writing as in force or in existence at the time the reference was included in this plan.

Note 1:    For references to Commonwealth Acts, see section 10 of the Acts Interpretation Act 1901; and  see also subsection 13(1) of the Legislation Act 2003 for the application of the Acts Interpretation Act 1901 to legislative instruments.

Note 2:    All Commonwealth Acts and legislative instruments are registered on the Federal Register of Legislation.

(d)     on page 3, omit “(Determined by the Australian Broadcasting Authority on 22 October 1998)”;

(e)      in Attachment 1.6:

(i)  for the Nominal location, omit “Broadcast Site 3km N of Urunga RALEIGH”, substitute “Broadcast Site 331 Yellow Rock Rd RALEIGH”;

(ii)  for the Easting coordinate, omit “503000”, substitute “503009”;

(iii) for the Northing coordinate, omit “6628900”, substitute “6628738”;

(iv) for the Output Radiation Pattern, omit the table, substitute the table at Part 1 of Schedule 1 to this instrument;

(v) at the end of the Attachment, omit the note, substitute:

Special Condition :-

The CMF at all elevations must not exceed the specified CMF at 0 degrees elevation for all angles of azimuth.

(f)      in Attachment 1.9, omit the Special Condition, substitute:

Advisory Note :-

The coverage area of this transmission is 5 kilometres measured from a point with the following AMG66 co-ordinates: Zone 56, Easting 510406, Northing 6652612.  This point is the same as the nominal transmitter site.

(g)     in Attachment 1.10, omit the Special Condition;

(h)     in Attachment 1.11:

(i)  for the Nominal location, omit “Vodafone site 43a Saye Place Emerald Heights WOOLGOOLGA”, substitute “Monopole Crown Castle Site 43b Saye Close EMERALD HEIGHTS”;

(ii)  for the Easting coordinate, omit “517520”, substitute “517553”;

(iii) for the Northing coordinate, omit “6663620”, substitute “6663646”;

(iv) for the Output Radiation Pattern, omit the table, substitute the table at Part 2 of Schedule 1 to this instrument;

(v) omit the Special Condition, substitute:

Advisory Note :-

Any transmission in accordance with this specification is planned on the basis that it will be protected to a minimum median field strength level of 66 dBuV/m against interference from other broadcasting services.


(i)       in Attachment 3.3:

(i)   for the Easting coordinate, omit “469904”, substitute “469965”;

(ii)  for the Northing coordinate, omit “6637003”, substitute “6637040”;

(j)       in Attachment 4.2, omit the Special Condition, substitute:

Advisory Note :-

The service has been planned on an interference limited basis; field strengths below the planned minimum median field strength level are likely to suffer interference from other broadcasting services.

Any transmission in accordance with this specification is planned on the basis that it will be protected to a minimum median field strength level of 66 dBuV/m against interference from other broadcasting services.
