Defence Determination, Conditions of Service Amendment (Post index locations) Determination 2018 (No. 37)

This determination amends the Defence Determination 2016/19, Conditions of service to omit Turin as a specific post index location and replace it with a general location for Italy, to provide Cyprus as a post index location, and to provide a transitional provision for members posted to Pisa, Italy before the commencement of this determination. It permits these members to receive benefits as the rate adjusted by the post index for the general location for Italy.

1  Name

                   This instrument is Defence Determination, Conditions of Service Amendment (Post index locations) Determination 2018 (No. 37).

2  Commencement

                   This instrument commences on 1 November 2018.

3  Authority

                   This instrument is made under section 58B of the Defence Act 1903.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Omit the items, substitute:

Schedule 2—Transitional provision

Defence Determination 2016/19, Conditions of service

Posting location – transitional provision

1.

This section applies to a member for whom both the following applied between 3 August 2018 and the commencement of this Determination.

 

a.

The member was posted to Pisa, Italy.

 

b.

The member was eligible for a benefit to which a post index adjustment would have been applied had a post index location been provided for the member's overseas posting location.

2.

The member is eligible for the difference between the following.

 

a.

The amount of a benefit the member would have been eligible to receive had Schedule 1 of this Determination commenced on 3 August 2018.

 

b.

The amount paid or payable to the member for the same benefit between 3 August 2018 and the commencement of this Determination to which paragraph a. applies.
