CASA EX100/18 Exemptions as made
This instrument grants an exemption to check pilots, who are approved under Civil Aviation Order 82.0, to conduct flight training and proficiency checks. The exemption provides the check pilots with a further transitional period to adjust to the new requirements under Part 61 of the Civil Aviation Safety Regulations 1998.

CASA EX100/18 — Flight Examiner Rating for CAO 82.0 Check Pilots Exemption 2018

1          Name

                 This instrument is CASA EX100/18 — Flight Examiner Rating for CAO 82.0 Check Pilots Exemption 2018.

2          Duration

                 This instrument:

(a)   commences on 1 September 2018; and

(b)   is repealed at the end of 31 August 2021.

3          Definitions

                 In this instrument:

check pilot has the meaning as defined in paragraph 2.1 of Civil Aviation Order 82.0.

check pilot approval, in relation to a person, means the document granting CASA’s approval of the person as a check pilot.

flight examiner rating has the same meaning as in Part 61 of CASR.

operator proficiency check has the meaning as defined in regulation 61.010 of CASR.

4          Application

                 This instrument applies to a check pilot when conducting an operator proficiency check within the scope of the check pilot approval, other than an operator proficiency check for the purposes of regulation 61.650, 61.695 or 61.880 of CASR.

5          Exemption

   (1)     The check pilot is exempt from the requirement in subregulation 61.375 (7) of CASR to hold a flight examiner rating.

   (2)     The exemption in subsection (1) is subject to the conditions mentioned in section 6.

6          Conditions

        (1)     While conducting an operator proficiency check, the check pilot must be employed or contracted by the operator for which the check is conducted.

        (2)     The check pilot must conduct the operator proficiency check in accordance with the operator’s approved training and checking system, as existing from time to time.

        (3)     The check pilot must conduct the operator proficiency check in accordance with all the conditions mentioned in the check pilot approval.
