These regulations amend the Corporations Regulations 2001 by repealing and substituting paragraph 5.3A.50(2)(f) to broaden the scope of the exclusion from the operation of the stay in sections 415D, 434J and 451E of the Corporations Act 2001.

1  Name

                   This instrument is the Corporations Amendment (Stay on Enforcing Certain Rights) Regulations (No. 2) 2018.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument

Immediately after the commencement of the Corporations Amendment (Stay on Enforcing Certain Rights) Regulations 2018.

                   This instrument is made under the Corporations Act 2001.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

  

Corporations Regulations 2001

1  Paragraph 5.3A.50(2)(f)

Repeal the paragraph, substitute:

                      (f)  a contract, agreement or arrangement for the supply of essential or critical goods or services to, or the carrying out of essential or critical works for:

                              (i)  the Commonwealth, a State or a Territory; or

                             (ii)  an authority of the Commonwealth or of a State or a Territory; or

                            (iii)  a local governing body established by or under a law of a State or Territory; or

                            (iv)  the public on behalf of an entity covered by subparagraph (i), (ii) or (iii);

Note:       Examples of these essential or critical goods, services or works include public transport services, public security or safety services, and works affecting essential public infrastructure.
