This instrument amends the Radiocommunications (Aircraft and Aeronautical Mobile Stations) Class Licence 2016 (the Class Licence). The Class Licence revoked and replaced the Radiocommunications (Aircraft and Aeronautical Mobile Stations) Class Licence 2006.

Radiocommunications (Aircraft and Aeronautical Mobile Stations) Class Licence Variation 2018 (No. 1)

 

The Australian Communications and Media Authority makes the following instrument under subsection 132(1) of the Radiocommunications Act 1992.

1  Name

                   This is the Radiocommunications (Aircraft and Aeronautical Mobile Stations) Class Licence Variation 2018 (No. 1).

2  Commencement

                   This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

3  Authority

                   This instrument is made under subsection 132(1) of the Radiocommunications Act 1992.

4  Amendments

                   The instrument that is specified in Schedule 1 is amended as set out in the applicable items in that Schedule.

 


 

Schedule 1—Amendments

Radiocommunications (Aircraft and Aeronautical Mobile Stations) Class Licence 2016 (F2016L01294)

1  Subsection 4(1) (definition of charter purposes)

Repeal the definition, substitute:

charter purposes means the purposes prescribed in paragraph 206 (1) (b) of the Civil Aviation Regulations 1988.

2  Subsection 4(1) (definition of Civil Aviation Regulations)

Repeal the definition.

3  Subsection 4(1) (after the definition of charter purposes)

Insert:

civil aviation instrument means:

                    (a)    the Civil Aviation Regulations 1988;

                   (b)    the Civil Aviation Safety Regulations 1998;

                    (c)    any other instrument made under the Civil Aviation Act 1988; or

                   (d)    any instrument made under the Civil Aviation Regulations 1988 or the Civil Aviation Safety Regulations 1998.

4  Subsection 4(1) (definition of Civil Aviation Orders)

Repeal the definition.

5  Subsection 4(1) (definition of sport aviation body)

Repeal the definition, substitute:

sport aviation body has the meaning given in Part 1 of the Dictionary to the Civil Aviation Safety Regulations 1998.

6  Section 6 (note 1)

Repeal the note, substitute:

Note 1  If radiocommunications equipment is required to be fitted to, or carried on, an aircraft under any civil aviation instrument, it must also comply with any relevant requirements under that civil aviation instrument.

7  Section 7

Repeal the section, substitute:

A person must not operate an aircraft station or an aeronautical mobile station unless the person is qualified to operate the station in accordance with the Civil Aviation Act 1988 or any civil aviation instrument.
