This instrument amends Part 2 of the List of Specimens taken to be Suitable for Live Import established under section 303EB of the EPBC Act by adding Holacanthus clarionensis (Clarion angelfish), to the list of specimens suitable for live import and updates the reference to Biosecurity Act 2015 in Parts 1 and 2. Under the listing of members of the family Pomacanthidae on Part 1 to notes that for Holacanthus clarionensis Part 2 should be consulted. This instrument allows live specimens of Holacanthus clarionensis be imported into Australia under Part 2 of the live import list.

List of Specimens Taken to be Suitable for Live Import Amendment 2018 (No. 2)

 

I, JOSH FRYDENBERG, Minister for the Environment and Energy, pursuant to subparagraphs 303EC (1)(a)(i) and 303EC (1)(a)(ii) of the Environment Protection and Biodiversity Conservation Act 1999, make the following amendments to the list of specimens taken to be suitable for live import, established under section 303EB of the Act:

 

1.     After the first paragraph of the Part 1- Live Specimens not requiring an import permit preamble, add the text:

Part 1 of the list must not contain a CITES specimen.

 

2.     In the preamble to Part 1 of the list:

Remove:

This list is also taken to include any live plant the introduction of which into Australia is in accordance with the Quarantine Act 1908, provided the plant is not included in the list of CITES specimens under this Act.

 

Add:

This list is also taken to include any live plant the introduction of which into Australia is in accordance with the Biosecurity Act 2015, provided the plant is not included in the list of CITES specimens under this Act.

 

3.     In the preamble to Part 2 of the list:

 

Remove:

This list is also taken to include any live plant included in the list of CITES specimens under this Act, provided the introduction of the plant into Australia is in accordance with the Quarantine Act 1908.

 

Add:

This list is also taken to include any live plant included in the list of CITES specimens under this Act, provided the introduction of the plant into Australia is in accordance with the Biosecurity Act 2015.

 

4.     Part 1 of the List: Under the heading Vertebrate Animals, Bony Fishes (Osteichthyes) Marine Fish in the appropriate alphabetic position:

5.     Part 2 of the list:

This amendment will take effect the day after registration on the Federal Register of Legislation.
