These regulations amend the Extradition (Commonwealth countries) Regulations 2010 to remove the reference to India from the list of extradition countries. It also amends the Extradition (Physical Protection of Nuclear Material) Regulations 1988 and the Extradition Regulations 1988 to amend the definition of Extradition Offences.

1  Name

                   This instrument is the Extradition Legislation Amendment (2017 Measures No. 1) Regulations 2017.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

                   This instrument is made under the Extradition Act 1988.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Extradition (Commonwealth countries) Regulations 2010

1  Schedule 1

Omit “India”.

Extradition (Physical Protection of Nuclear Material) Regulations 1988

2  Regulation 2

Insert:

Physical Protection Convention has the same meaning as in the Nuclear NonProliferation (Safeguards) Act 1987.

3  Regulation 2 (definition of the Physical Protection Convention)

Repeal the definition.

Extradition Regulations 1988

4  Regulation 2

Insert:

Physical Protection Convention has the same meaning as in the Nuclear NonProliferation (Safeguards) Act 1987.

5  Paragraph 2B(1)(h)

Repeal the paragraph, substitute:

                     (h)  Article 7 of the Physical Protection Convention.
