This determination precludes Judges of the Federal Circuit Court of Australia and members of the federal parliament to whom Division 1 of Part 2 of the Parlimentary Superannuation Act 2004 applies from membership of the Public Sector Superannuation Accumulation Plan as ‘former Commonwealth ordinary employer-sponsored members’ under the new extended membership arrangements. This provides consistency with current membership arrangements for these two classes of office.

1  Name

                   This instrument is the Superannuation (PSSAP—Former Commonwealth Ordinary Employer‑Sponsored Member) Determination 2017.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument

Immediately after the commencement of Schedule 1 to the Superannuation Amendment (PSSAP Membership) Act 2017.

3  Authority

                   This instrument is made under subsection 18(10) of the Superannuation Act 2005.

4  Classes of persons who cannot be ordinary employer‑sponsored members under subsection 18(7) of the Superannuation Act 2005

                   For the purposes of subsection 18(10) of the Superannuation Act 2005, the classes of persons are the following:

                     (a)  Judges of the Federal Circuit Court of Australia;

                     (b)  persons to whom Division 1 of Part 2 of the Parliamentary Superannuation Act 2004 applies.
