1 Name
This is the Variation to Licence Area Plan – Sale Radio – 2017 (No.1).
2 Commencement
This instrument commences at the same time as the Broadcasting Services (Technical Planning) Guidelines 2017.
3 Authority
This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.
4 Variation
The Licence Area Plan – Sale Radio – December 2001 (F2005B00823) is varied as follows:
(a) rename the instrument as the “Licence Area Plan – Sale Radio”;
(b) amend the heading on the title page so that it reads “Licence Area Plan – Sale Radio”;
(c) under the heading “DETERMINATION” number each of the paragraphs as clauses (1) to (3);
(d) omit clause (1) and substitute the following:
“This plan for broadcasting services in the Sale area of Victoria is made under subsection 26(1) of the Broadcasting Services Act 1992.”;
(e) in clauses (2) and (3), omit each occurrence of “Determination” and substitute “plan”;
(f) following clause (3), insert the following clause:
“(4) In this plan, unless the contrary intention, appears:
(a) a reference in this plan to a schedule or an attachment is a reference to a schedule or an attachment to this plan; and
(b) a reference to the Technical Planning Guidelines is a reference to the Broadcasting Services (Technical Planning) Guidelines 2017, as in force from time to time; and
(c) a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and
(d) a reference to any other kind of instrument or writing is a reference to that other kind of instrument or writing as in force or in existence at the time the reference was included in this plan.

(g) omit all the text on the page with the heading “SCHEDULES”;
(h) in each of Schedules One and Two and Attachments 1.2 to 1.17, 2.2 and 2.3, omit each occurrence of “Licence Area Plan : Sale Radio – December 2001” and substitute with “LICENCE AREA PLAN : Sale Radio”;
(i) in each of the Attachments 1.2 to 1.17, 2.2 and 2.3:
(i) omit each occurrence of “Frequency Band & Mode” and substitute “Frequency Band & Mode :”; and
(ii) omit each occurrence of “Maximum antenna height” and substitute “Maximum Antenna Height :”; and
(iii) omit each occurrence of “Polarisation” and substitute
“Polarisation :”;
(j) in the Schedules:
(i) in Schedule One and Schedule Two, omit the column headed “Status” in the tables;
(ii) in the table at Schedule One, omit the row for Service Licence No SL4157, and substitute :

(m) in Attachment 1.1:
(i) omit the following text:

(ii) substitute the following text:

(n) immediately following Attachment 1.10 insert Attachment 1.10A, at Schedule 3 to this instrument;
(o) in each of Attachments 1.13 to 1.17 (inclusive), omit the text “Special Condition” and substitute “Advisory Note”;
(p) in Attachment 1.16, immediately after “Advisory Note”:
(i) omit the text “This service is interference limited, only field strength levels of 66 dBmV/m and above will be protected from interference.”; and
(ii) substitute the text “Any transmission in accordance with this specification is planned on the basis that it will be protected to a minimum median field strength level of 66 dBuV/m against interference from other broadcasting services. The service has been planned on an interference limited basis; field strengths below the planned minimum median field strength level are likely to suffer interference from other broadcasting services.”; and
(q) in Attachment 2.1:
(i) omit the following text:
“LICENCE AREA FOR SERVICE LICENCE NUMBER: SL5266
EAST GIPPSLAND COMMUNITY RADIO”; and
(ii) substitute the following text:
“LICENCE AREA – East Gippsland RA1
