1. Name
This instrument is the Variation to Licence Area Plan – Karratha (Radio) – 2017 (No.1).
2. Commencement
This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.
Note: The Federal Register of Legislation may be accessed at www.legislation.gov.au.
3. Authority
This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.
4. Variation
The Licence Area Plan – Karratha (Radio) – June 1996 (F2005B01252), is varied as follows:
(a) rename the instrument as “Licence Area Plan – Karratha Radio”;
(b) amend the heading on the title page so that it reads “Licence Area Plan – Karratha Radio”;
(c) on the first page of the instrument:
(i) amend the heading so that it reads “Licence Area Plan – Karratha Radio”; and
(ii) number the two paragraphs as clauses (1) and (2);
(d) omit clauses (1) and (2) and substitute the following clauses:
“(1) This plan for broadcasting services in the Karratha area of Western Australia is made under subsection 26(1) of the Broadcasting Services Act 1992.
(2) Five national radio broadcasting services, two commercial radio broadcasting services and three open narrowcasting radio services are to be available in the area described at Attachment 1.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.2 – 1.14 to this plan.
(3) In this plan, unless the contrary intention, appears:
(a) a reference to a schedule or an attachment includes a reference to that schedule or attachment as amended from time to time;
(b) a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and
(c) a reference to any other kind of instrument or writing is a reference to that other instrument or writing as in force or in existence at the time the reference was included in this plan.
Note 1: For references to Commonwealth Acts, see section 10 of the Acts Interpretation Act 1901; and see also subsection 13(1) of the Legislation Act 2003 for the application of the Acts Interpretation Act 1901 to legislative instruments.
Note 2: All Commonwealth Acts and legislative instruments are registered on the Federal Register of Legislation.”;
(e) immediately before Schedule One:
(i) omit the headings “SCHEDULE”;
(ii) omit the words “The Schedule sets out:” and all six paragraphs marked with dots points that follow;
(f) omit Schedule One and substitute Schedule One to this instrument; and
(g) omit all Attachments and substitute all Attachments of this instrument.
