I, PETER DUTTON, Minister for Immigration and Border Protection, acting under
regulation 1.03, subregulation 1.15I(1) and 2.26B(1), paragraphs 2.72(10)(aa) and 2.72B(3)(b), sub-subparagraph 5.19(4)(h)(i)(A), Item 4(a) of the table in subitem 1137(4), Item 4(a) of the table in subitem 1138(4) and Item 4(a) of the table in subitem 1230(4), paragraph 1229(3)(k) and paragraph 186.234(2)(a) of the Migration Regulations 1994 (the Regulations):

1.             REVOKE Instrument IMMI 15/092 (F2015L01059), signed on 25 June 2015 and REVOKE Instrument IMMI 15/108 (F2015L01147), signed on 6 July 2015; and

2.             SPECIFY  for the purposes of paragraph 2.72(10)(aa) of the Regulations, the occupations and their corresponding 6-digit code listed in Columns A and B of Schedule 1 and Columns A and B of Schedule 2 to this Instrument; and

3.             SPECIFY, in relation to a person who is issued an invitation on or after 1 July 2016 to make an application for a:

a)             Subclass 189 Skilled – Independent visa; or

b)             Subclass 489 Skilled – Regional (Provisional) visa, if the applicant is not nominated by a State or Territory government agency;

and if applicable, in relation to a spouse or de facto partner of that person:

                                      i)      each occupation listed in Column A of Schedule 1 to this Instrument is to be a skilled occupation that is applicable to the person, for the purposes of paragraph 1.15I(1)(a) of the Regulations; and

                                    ii)      the person or body listed in Column D of Schedule 1 to this Instrument is the relevant assessing authority for the corresponding skilled occupation listed in Column A of Schedule 1 to this instrument, for the purposes of paragraph 2.26B(1)(a) of the Regulations; and

                                  iii)      the country or countries corresponding to each skilled occupation listed in Column A of Schedule 1 and relevant assessing authority listed in Column D of Schedule 1 to this Instrument as the country or countries for which the specified person or body is the relevant assessing authority for the purposes of an application for a skills assessment in that skilled occupation made by a resident of one of those countries included in Column C of Schedule 1 to this Instrument, for the purposes of paragraph 2.26B(1)(b) of the Regulations; and

                                  iv)      each skilled occupation in Column A of Schedule 1 to this instrument that is applicable to the person, for the purposes of Item 4(a) of the table in subitem 1137(4) and Item 4(a) of the table in subitem 1230(4) of Schedule 1 to the Regulations; and

4.             SPECIFY, in relation to a person who applies on or after 1 July 2016 for a Subclass 485 Temporary Graduate visa:

a)             each occupation listed in Column A of Schedule 1 to this Instrument is to be a skilled occupation that is applicable to the person, for the purposes of paragraph 1.15I(1)(a) of the Regulations; and

b)             the person or body listed in Column D of Schedule 1 to this Instrument is the relevant assessing authority for the corresponding skilled occupation listed in Column A of Schedule 1 to this Instrument; for the purposes of paragraph 2.26B(1)(a) of the Regulations; and

c)             the country or countries corresponding to each skilled occupation listed in Column A of Schedule 1 and relevant assessing authority listed in Column D of Schedule 1 to this Instrument as the country or countries for which the specified person or body is the relevant assessing authority for the purposes of an application for a skills assessment in that skilled occupation, made by a resident of one of those countries included in Column C of Schedule 1 to this Instrument, for the purposes of paragraph 2.26B(1)(b) of the Regulations; and

d)            each skilled occupation in Column A of Schedule 1 to this Instrument that is applicable to the person, for the purposes of paragraph 1229(3)(k) of Schedule 1 to the Regulations; and

5.             SPECIFY, in relation to a person who is nominated by a State or Territory government agency, or the spouse or de facto partner of a person who is nominated by a State or Territory government agency, and who is issued an invitation, on or after 1 July 2016 to make an application for a:

a)             Subclass 190 Skilled – Nominated visa; or

b)             Subclass 489 Skilled – Regional (Provisional) visa;

and, if applicable, in relation to the spouse or de facto partner of that person:

                                      i)     each occupation listed in Column A of Schedule 1 and Column A of Schedule 2 to this Instrument is to be a skilled occupation that is applicable to the person, for the purposes of paragraph 1.15I(1)(a) of the Regulations; and

                                ii)          the person or body listed in Column D of Schedule 1 and Column D of Schedule 2 to this Instrument is the relevant assessing authority for the corresponding skilled occupation listed in Column A of Schedule 1 and Column A of Schedule 2 to this Instrument, for the purposes of paragraph 2.26B(1)(a) of the Regulations; and

                              iii)          the country or countries corresponding to each skilled occupation listed in Column A of Schedule 1 and Column A of Schedule 2 to this Instrument and relevant assessing authority listed in Column D of Schedule 1 and Column D of Schedule 2 to this Instrument as the country or countries for which the specified person or body is the relevant assessing authority for the purposes of an application for a skills assessment in that skilled occupation, made by a resident of one of those countries included in Column C of Schedule 1 and Column C of Schedule 2 to this Instrument, for the purposes of paragraph 2.26B(1)(b) of the Regulations; and

                              iv)          each skilled occupation in Column A of Schedule 1 and Column A of Schedule 2 to this Instrument that is applicable to the person, for the purposes of Item 4(a) of the table in subitem 1138(4) and Item 4(a) of the table in subitem 1230(4) of Schedule 1 to the Regulations; and

6.             SPECIFY for the purposes of sub-subparagraph 5.19(4)(h)(i)(A) of the Regulations, each occupation listed in Column A of Schedule 1 and Column A of Schedule 2 to this Instrument, in relation to an application for approval of a nomination made on or after
1 July 2016 for a Subclass 186 Employer Nomination Scheme visa; and

7.             SPECIFY for the purposes of paragraph 186.234(2)(a) of Schedule 2 to the Regulations, each person or body listed in Column D of Schedule 1 and Column D of Schedule 2 to this Instrument as the assessing authority for the corresponding occupation listed in Column A of Schedule 1 and Column A of Schedule 2 to this Instrument, in relation to a person who applies on or after 1 July 2016 for a Subclass 186 Employer Nomination Scheme visa; and

8.             SPECIFY for the purposes of paragraph 2.72B(3)(b) of the Regulations, the occupations and their corresponding 6-digit code listed in Columns A and B of Schedule 1 and Columns A and B of Schedule 2 to this Instrument, in relation to the nominated occupational training in relation to an application made on or after 19 November 2016 for a Subclass 407 (Training) visa;

9.             SPECIFY for the purposes of regulation 1.03 of the Regulations, that the meaning of ANZSCO is the Australian and New Zealand Standard Classification of Occupations published by the Australian Bureau of Statistics and current as at 1 July 2016.

10.         All specifications in the attached Schedule 1 and Schedule 2 to this Instrument are to be interpreted according to the qualifications in the Notes attached to this Instrument.

Note 3.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions in a limited service restaurant.  A limited service restaurant includes, but is not limited to, any of the following:

a)              fast food or takeaway food services;

b)              fast casual restaurants;

c)              drinking establishments that offer only a limited food service;

d)              limited service cafes including, but not limited to, coffee shops or mall cafes;

e)              limited service pizza restaurants.

Note 4.    Minister of Religion is specified as a skilled occupation only for the purposes of paragraph 2.72B(3)(b) of the Regulations, and only in relation to an application for a Subclass 407 (Training) visa. Minister of Religion is not specified as a skilled occupation in relation to any other visa subclass, despite paragraphs 2, 5, 6 and 8.

Note 5.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)              clerical, book keeper and accounting clerk positions;

b)              positions in a business that have an annual turnover of less than
AUD 1 million;

c)              positions in a business that have fewer than five employees.

Note 6.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related  to animal husbandry including, but not limited to, caring for livestock on a farm setting.

Note 7.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related to mass or standardised production, including positions based in a franchise or factory, as opposed to specialist production. Positions excluded, but not limited to the following exclusions, are any of the following:

a)              positions that involve full or partial production of food product for distribution to another location;

b)              positions that predominantly involve the use of pre-prepared food product from another location.

Note 8.   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)              positions that are not located in a commercial building or shopping centre environment;

b)              positions that predominately involve the management of the provision of only one particular service to a facility or managing one particular relationship.

Example:    a position that manages the cleaning contract for a facility but not other contracts relevant to the facility.

Note 9.   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)              positions in a business that have an annual turnover of less than AUD 1 million;

b)              positions that have a nominated base salary of less than AUD 65,000.


 

Note 10: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)              positions based in a front-line retail setting;

b)              positions that predominately involve direct client transactional interaction on a regular basis;

c)              positions in a business that have an annual turnover of less than AUD 1 million;

d)              positions that have a nominated base salary of less than AUD 65,000.

Note 11.  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions involved in mass production in a factory setting and positions in a limited service restaurant.  A limited service restaurant includes, but is not limited to, any of the following:

a)              fast food or takeaway food services;

b)              fast casual restaurants;

c)              drinking establishments that offer only a limited food service;

d)              limited service cafes including, but not limited to, coffee shops or mall cafes;

e)              limited service pizza restaurants.

Note 12.  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that predominantly involve low-skilled tasks. 

Examples:    fruit picking or packing, feeding of livestock or animals

Note 13:  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)              positions that predominately involve hair dressing and/or beauty therapy related non-managerial tasks; or

b)              positions in a business that employ fewer than five employees.


 

Note 14:  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)              non full-time positions;

b)              positions that are not based in a therapeutic setting;

c)              positions involving the provision of  non-medical relaxation massage.

Note 15:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)              positions that are based in a front-line retail setting;

b)              positions that are based in a call centre and do not require a significant technical knowledge of products;

c)              positions that predominantly involve selling educational courses to individual students;

d)              positions that have a nominated base salary of less than AUD 65,000.

Note 16:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)              truck driver positions;

b)              fleet manager positions;

c)              container controller positions;

d)              positions in a business that have an annual turnover of less than AUD 1 million;

e)              positions in a business that have fewer than five employees.

Note 17:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any one of the following:

a)              positions in a business that have an annual turnover of less than AUD 1 million;

b)              positions in a business that have fewer than five employees;

Note 19:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that predominately involve  responsibility for managing hotel or motel staff.  The specification does not exclude positions that predominately involve responsibility for organising and controlling the operations of a hotel or motel that may have limited duties requiring management of hotel or motel staff but is not the main function of the position.

Note 20:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that do not require a minimum of two years relevant work experience.

Note 21:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
