Veterans’ Entitlements (Exempt Lump Sum – The Netherlands Government Compensation Payments) Determination 2016
I, MARK HARRIGAN, delegate of the Repatriation Commission, make the following determination for paragraph 5H(12)(c) of the Veterans’ Entitlements Act 1986.

1 Name
This instrument is the Veterans’ Entitlements (Exempt Lump Sum – The Netherlands Government Compensation Payments) Determination 2016.
2 Commencement
This instrument is taken to have commenced on 1 March 2016.
3 Authority
This instrument is made under paragraph 5H(12)(c) of the Veterans’ Entitlements Act 1986 (VEA).
4 Definitions
In this instrument:
“income support supplement” means the payment called the income support supplement payable under Part IIIA of the VEA;
“service pension” has the meaning given to service pension in subsection 5Q(1) of the VEA.
“Netherlands compensation payment” means a payment made by the Netherlands Government to people who were civil servants or military personnel and who were in the service of the Dutch East Indies Government during the Japanese occupation of the Dutch East Indies during World
War 2.
5 Exempt lump sum
If a person or a person’s partner receives a Netherlands compensation payment and the person is eligible for, or in receipt of a service pension or income support supplement, then the amount of the Netherlands compensation payment received by the person or the person’s partner is an exempt lump sum.
