ARRANGEMENTS FOR APPLICATIONS FOR BRIDGING VISAS 2016/095

(Items 1301, 1302, 1303, 1304, 1305 and 1306 – Bridging A, B, C, D, E and F visas)

I, PETER DUTTON, Minister for Immigration and Border Protection, acting under subregulation 2.07(5) of the Migration Regulations 1994 (the Regulations) for items 1301, 1302, 1303, 1304, 1305 and 1306 of Schedule 1 to the Regulations:

1.             REVOKE Instrument IMMI 16/014, Arrangements for Applications for Bridging
Visas 2016/014 (
F2016L00554), signed on 18 April 2016.

2.             SPECIFY the required approved forms in the Schedule to this Instrument, for the following subitems of the Regulations:

a.              1301(1) – Bridging A (Class WA);

b.             1302(1) – Bridging B (Class WB);

c.              1303(1) – Bridging C (Class WC);

d.             1304(1) – Bridging D (Class WD);

e.              1305(1) – Bridging E (Class WE); and

f.              1306(1) – Bridging F (Class WF).

3.             SPECIFY that the required place and the required manner for making an application, is the same as the place and manner for making an application for a substantive visa of the relevant class, where the form specified in the Schedule to the Instrument is also the form for making the substantive visa application, for the following paragraphs of the Regulations:

a.              1301(3)(a) – Bridging A (Class WA);

b.             1302(3)(a) – Bridging B (Class WB);

c.              1303(3)(a) – Bridging C (Class WC);

d.             1304(3)(a) – Bridging D (Class WD);

e.              1305(3)(a) – Bridging E (Class WE); and

f.              1306(3)(a) – Bridging F (Class WF).

4.             SPECIFY that in circumstances other than those specified in paragraph 3 of this Instrument, the application must be made at an office of immigration in Australia, but not in immigration clearance, for the following paragraphs of the Regulations:

a.              1301(3)(a) – Bridging A (Class WA);

b.             1302(3)(a) – Bridging B (Class WB);

c.              1303(3)(a) – Bridging C (Class WC);

d.             1304(3)(a) – Bridging D (Class WD);

e.              1305(3)(a) – Bridging E (Class WE); and

f.              1306(3)(a) – Bridging F (Class WF).

5.             SPECIFY that for applications for a Bridging E (Class WE) visa, applications made on paper forms 1005 and 1008 may be made by email to:

a.              BVEapplication.WA@border.gov.au;

b.              BVEapplication.QLD@border.gov.au;

c.              BVEapplication.NSW@border.gov.au;

d.             BVEapplication.VIC@border.gov.au;

e.              BVEapplication.SA@border.gov.au;

f.              BVEapplication.NT@border.gov.au;

g.             BVEapplication.ACT@border.gov.au;

h.             BVEapplication.TAS@border.gov.au;

i.               NSW.detention.bve.team@border.gov.au; and

j.               NSW.detention.bve.team@immi.gov.au.

6.             SPECIFY that for applications for a Bridging E (Class WE) visa, applications made on paper forms 1005 and 1008 must not be made by fax.
