This regulation repeals and replaces the Fair Work (Building Industry—Accreditation Scheme) Regulations 2005, which prescribe the accreditation scheme for persons who wish to carry out Commonwealth funded building work for the purposes of section 35 of the Fair Work (Building Industry) Act 2012. In the absence of this repeal, those regulations would sunset on 1 April 2016 in accordance with the Legislation Act 2003.

General Comments: This regulation was originally made for the purposes of section 35 of the Fair Work (Building Industry) Act 2012 and continues in force after 2 December 2016 as if the regulations were rules made by the Minister for the purposes of section 43 of the Building and Construction Industry (Improving Productivity) Act 2016 (see Schedule 2, item 11 of the Building and Construction Industry (Consequential and Transitional Provisions) Act 2016).
