Removal of Prisoners (Territories) Regulation 2015

This regulation repeals and re-makes the Removal of Prisoners (Territories) Regulations in their same form and ensures the continuation of an administrative process that allows prisoners to make an application to the Secretary of the Commonwealth Department with administrative responsibility for the Territories, to return to a Territory after the expiration of their custodial sentence, at no cost to themselves.

1  Name

                   This is the Removal of Prisoners (Territories) Regulation 2015.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

                   This instrument is made under the Removal of Prisoners (Territories) Act 1923.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

5  Definitions

                   In this instrument:

Act means the Removal of Prisoners (Territories) Act 1923.

Secretary means the Secretary of the Department.

6  Return of removed prisoner

                   For subsection 8(3) of the Act, an application by a person for return to a Territory must be made to the Secretary within 14 days after the person’s discharge or release from custody.
