Part 1               Preliminary

1.               Name of Rules

This Rule is the PCEHR (Assisted Registration) Amendment (support of parental responsibility claim) Rule 2015.

2.               Commencement

The Rule commences on the day after it is registered on the Federal Register of Legislative Instruments. 

3.               Amendment of PCEHR (Assisted Registration) Rules 2012

Schedule 1 amends the PCEHR (Assisted Registration) Rules 2012.     

 


Schedule 1       Amendments

(section 3)

[1]             Sub-subparagraph 3(2)(a)(ii)(A)

Repeal.

[2]             Sub-subparagraph 3(2)(a)(ii)(B)

Renumber as sub-subparagraph 3(2)(a)(ii)(A).

[3]             Sub-subparagraph 3(2)(a)(ii)(C)

Renumber as sub-subparagraph 3(2)(a)(ii)(B).

[4]             After subrule 3(2)

Insert:

(3)      For the purposes of paragraph 3(2)(a), the consumer who is applying to be recognised by the System Operator, under section 6 of the Act, as an authorised representative of a person aged under 18 years, must:

(a)      be co-located on the same Medicare card as the person; or

(b)     be applying in respect of a person who is aged not more than 14 days; or

(c)      be the subject of a declaration by the healthcare provider organisation that it supports the consumer’s assertion under sub‑subparagraph 3(2)(a)(ii)(A) of parental responsibility for the person.

[5]             After rule 6

Insert:

6A.         Declaration to support a consumer’s assertion of parental responsibility

Before making a declaration to support a consumer’s assertion of parental responsibility for a person, the healthcare provider organisation must exercise reasonable care.
