Part 1Preliminary

  

1  Name of determination

                   This determination is the Annual Prudential Compliance Statement Determination 2014.

2  Commencement

                   This determination commences on registration.

3  Cessation

                   This determination ceases on 1 July 2015.

4  Authority

                   This determination is made under paragraph 51(1)(e) of the Fees and Payments Principles 2014 (No 2).

5  Definitions

                   In this determination:

Act means the Aged Care Act 1997.

annual prudential compliance statement, of an approved provider, means the annual prudential compliance statement required to be given under section 51 of the Fees Principles.

approved provider has the same meaning as in the Act.

different financial year means the financial year approved in accordance with section 59 of the Fees Principles, or section 32 of the Accountability Principles 2014

Fees Principles means the Fees and Payments Principles 2014 (No 2).

post 1 July requirements means the matters to be included in annual prudential compliance statements as set out in the Fees Principles.

pre 1 July requirements means the matters to be included in annual prudential compliance statements as set out in the User Rights Principles.

relevant financial year means;

(a)   the 2013-14 financial year; or

(b)   if approved in accordance with section 59 of the Fees Principles, or section 32 of the Accountability Principles 2014, that different year.

User Rights Principles means the User Rights Principles 1997 as in force on 30 June 2014.

Part 2Matters to be included in Annual Prudential Compliance Statement

  

6  Purpose of this Part

This Part specifies, for the purposes of paragraph 51(1)(e) of the Fees Principles, additional matters that are to be included in the annual prudential compliance statement from approved providers to the Secretary.

7  Information to be included in annual prudential compliance statement for the 2013-14 financial year

(1)   If an approved provider does not have approval under section 59 of the Fees Principles, or section 32 of the Accountability Principles 2014 for a different financial year the annual prudential compliance statement for the relevant financial year must include;

(a)     the pre 1 July requirements set out in column 1 of the table; and

(b)    a statement about whether the approved provider has, during the financial year, complied with:

                                                                            i.      paragraph 57-2(1)(e) of the Act as in force on 30 June 2014; and

                                                                          ii.      subsection 23.28(3), and Divisions 2 and 5 of Part 4, of the User Rights Principles.

(2)   To the extent an item in column 1 of the table includes a corresponding item in column 2 of the table the annual prudential compliance statement for the relevant financial year must include the matters set out in column 1 of the table instead of the matters set out in column 2.

8  Information to be included in annual prudential compliance statement for a different financial year

(1)   If an approved provider does have approval under section 59 of the Fees Principles, or section 32 of the Accountability Principles 2014 for a different financial year the annual prudential compliance statement for the relevant financial year must include:

(a)     the pre 1 July requirements set out in column 1 of the table at the end of subsection 7(2) of this determination in relation to so much of the relevant financial year that occurred before1 July 2014; and

(b)    the things set out in section 51 of the Fees Principles in relation to so much of the relevant financial year that occurred after 1 July 2014.
