This regulation amends the Customs Regulations 1926 to prescribe the Fisheries Management Act 1991, the Environment Protection and Biodiversity Conservation Act 1999, and the Torres Strait Fisheries Act 1984 for the purposes of new subsection 228(2) of the Customs Act 1901 (the Act) and the Maritime Powers Act 2013 for the purposes of new subsection 228(3) of the Act. The Regulation also removes references in the Customs Regulations 1926 to provisions in the Act which will be repealed by the Maritime Powers (Consequential Amendments) Act 2013.

1  Name of regulation

                   This regulation is the Customs Amendment (Maritime Powers Consequential Amendments) Regulation 2014.

2  Commencement

                   Each provision of this regulation specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Immediately after the commencement of Schedule 1 to the Maritime Powers (Consequential Amendments) Act 2013.

 

3  Authority

                   This regulation is made under the Customs Act 1901.

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

1  After regulation 178

Insert:

178A  Forfeited ships—prescribed Acts

             (1)  For paragraph 228(2)(c) of the Act, the following are prescribed:

                     (a)  the Fisheries Management Act 1991;

                     (b)  the Environment Protection and Biodiversity Conservation Act 1999;

                     (c)  the Torres Strait Fisheries Act 1984.

             (2)  For paragraph 228(3)(c) of the Act, the Maritime Powers Act 2013 is prescribed.

2  Schedule 1AAD (table item 11A)

Omit “paragraph 185B(2)(b)”.

3  Schedule 1AAD (table items 11B and 14)

Repeal the items.

4  Schedule 1AAD (cell at table item 14A, column headed “is prescribed for this provision or these provisions of the Customs Act 1901 …”)

Repeal the cell, substitute:

subparagraph 186A(1)(b)(ii)

5  Schedule 1AAD (table item 16)

Repeal the item.
