This regulation amends the National Measurement Regulations 1999 to adjust the fees prescribed in Schedule 13 for the pattern approval services of the National Measurement Institute to reflect the increased cost of providing these services consistent with the requirements of the Australian Government Cost Recovery Guidelines.

1  Name of regulation

                   This regulation is the National Measurement Amendment (Fees and Verification) Regulation 2013.

2  Commencement

                   This regulation commences on 1 July 2013.

3  Authority

                   This regulation is made under the National Measurement Act 1960.

4  Schedule(s)

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

  

National Measurement Regulations 1999

1  Regulation 3 (definition of verifying authority)

Repeal the definition, substitute:

verifying authority:

                     (a)  for all standards of measurement and artefacts—means the Chief Metrologist; and

                     (b)  for Australian secondary standards of measurement of ionising radiation—includes:

                              (i)  the Chief Executive Officer of the Australian Nuclear Science and Technology Organisation; and

                             (ii)  the Chief Executive Officer of the Australian Radiation Protection and Nuclear Safety Agency; and

                     (c)  for a particular reference standard of measurement—includes a body or person appointed under regulation 73 in relation to reference standards of measurement of the same kind as the particular reference standard of measurement; and

                     (d)  for a particular artefact—includes a body or person appointed under regulation 73 in relation to an artefact of the same kind as the particular artefact.

2  Regulation 9

Repeal the regulation, substitute:

9  Verification of Australian secondary standard of measurement

             (1)  The Chief Metrologist may verify an Australian secondary standard of measurement.

             (2)  The Chief Executive Officer of the Australian Nuclear Science and Technology Organisation may verify an Australian secondary standard of measurement of ionising radiation.

             (3)  The Chief Executive Officer of the Australian Radiation Protection and Nuclear Safety Agency may verify an Australian secondary standard of measurement of ionising radiation.

3  Clause 1A.1 of Schedule 13

Before “The following”, insert “(1)”.

4  Clause 1A.1 of Schedule 13

Omit “The”, substitute “Subject to subclause (2), the”

5  Clause 1A.1 of Schedule 13 (at the end of the table)

Add:

             (2)  For an instrument or activity mentioned in items 4(b), 4(f), 7(b), 7(d) or 7(e) of the table to Part 1A.1 of this Schedule:

                     (a)  fees prescribed for the activity mentioned in item 10 of the table to Part 1 of this Schedule do not apply to this subregulation; and

                     (b)  for this subregulation, the fee for the activity mentioned in item 10 of the table to Part 1 of this Schedule is $220 per hour.

Repeal the Parts, substitute:
