Australian Communications and Media Authority (Spectrum Licence Allocation – Combinatorial Clock Auction – Eligibility Deadline and Payment Terms) Direction 2013

 

I, STEPHEN MICHAEL CONROY, Minister for Broadband, Communications and the Digital Economy make the following direction under section 14 of the Australian Communications and Media Authority Act 2005.

1               Name of Direction

This direction is the Australian Communications and Media Authority (Spectrum Licence Allocation – Combinatorial Clock Auction – Eligibility Deadline and Payment Terms) Direction 2013.

2               Commencement

This direction commences on the day it is made.

3               Cessation

This direction ceases to have effect as if repealed by another instrument 24 months after it commences.

4               Interpretation

In this direction:

ACMA means the Australian Communications and Media Authority.

Combinatorial Clock Auction Determination means the Radiocommunications (Spectrum Licence Allocation – Combinatorial Clock Auction) Determination 2012.

Eligibility Deadline means the date and time specified by the ACMA in accordance with paragraph 4.4(1)(f) of the Combinatorial Clock Auction Determination.

                 

 

5               Direction

(1)   I direct the ACMA that it must not notify a winning bidder under subsection 6.8(1) of the Combinatorial Clock Auction Determination of the balance of the bidder’s winning price before:

 

(a)    if any of the spectrum licences to be issued for the parts of the spectrum allocated to the bidder has a commencement date of 1 October 2014 — 19 August 2014; or

 

(b)   otherwise — 1 October 2014.

 

(2)   I direct the ACMA:

 

(a)    to extend the date of the Eligibility Deadline from 21 March 2013 to 28 March 2013; and

 

(b)   to publish another notice on its website, in accordance with subsection 4.4(2) of the Combinatorial Clock Auction Determination, giving details of the change to the date of the Eligibility Deadline.
