This instrument declares that the Fair Entitlements Guarantee Act 2012 applies to persons who were employed by Rosella Foods Pty Ltd and Rosella Holdco Pty Ltd (Receiver and Managers Appointed) (Administrators Appointed)(Rosella Foods). This declaration allows any former employees of Rosella Foods to make a claim under the Act and receive an advance if they are eligible.

I, WILLIAM RICHARD SHORTEN, Minister for Employment and Workplace Relations, make this declaration under section 49 of the Fair Entitlements Guarantee Act 2012.

1.         Name of declaration

This declaration is the Fair Entitlements Guarantee (Extended operation of the Act in relation to Rosella Foods Pty Ltd and Rosella Food Holdco Pty Ltd in Administration) Declaration 01/2013.

2.         Commencement

This declaration commences on the day after it is registered on the Federal Register of Legislative Instruments.

3.         Declaration

The Fair Entitlements Guarantee Act 2012 applies in relation to persons who were employed, but are no longer employed, by: 

·         Rosella Foods Pty Ltd (Receivers and Managers Appointed) (Administrators Appointed), and

·         Rosella Food Holdco Pty Ltd (Receivers and Managers Appointed) (Administrators Appointed) (together called ‘Rosella Foods’)

which are entities in administration under the Corporations Act 2001.
