I, TANYA PLIBERSEK, Minister for Health, make these Rules under section 60(1) of the Dental Benefits Act 2008.

1              Name of Rules

                These Rules are the Dental Benefits Amendment Rules 2012.

2              Commencement

                These Rules commence on 1 January 2013.

3              Amendment of Dental Benefits Rules 2009

                Schedule 1 amends the Dental Benefits Rules 2009.



Schedule 1     Amendment

 

[1]           Rule 4, after definition of MRCAETS

insert

oral health therapist means a person who is registered or entitled to practice as an oral health therapist under a law of a State or Territory.

[2]           Rule 6

omit (wherever occurring)

are registered with Medicare Australia

insert

have been allocated a provider number by the Chief Executive Medicare

[3]           Rule 7, paragraph (a)

substitute

(a)    a dental service may be rendered on behalf of a dental provider by the following classes of persons:

(i)     dental hygienists;

(ii)       dental therapists;

(iii)     oral health therapists; and

[4]           Subrules 10 (2), 10 (3) and rule 11
