This instrument specifies as classes, persons whose usual place of residence is within one of five local government areas located in New South Wales, Queensland, South Australia and Victoria. The specified local government areas coincide with those declared from 1 July 2012 as income management areas by separate instrument. The specification will enable the Secretary to determine, by writing under subsection 123UGB(1), that a person is an exempt welfare payment recipient if the Secretary is satisfied that the person is included in one of the classes of persons specified in this instrument.

Social Security (Administration) Act 1999

I, JENNY MACKLIN, Minister for Families, Community Services and Indigenous Affairs and Minister for Disability Reform, acting under subsection 123UGB(2) of the Social Security (Administration) Act 1999 and on behalf of the Minister for Employment and Workplace Relations and the Minister for Tertiary Education, Skills, Science and Research, make this Specification.

1              Name of Specification

                This Specification is the Social Security (Administration) (Classes of Exempt Welfare Payment Recipients) Specification 2012.

2              Commencement

                This Specification commences on 1 July 2012.

3              Definition

                In this Specification:

                Act means the Social Security (Administration) Act 1999.

4              Exempt class - New South Wales

(1)        For subsection 123UGB(2) of the Act, the class of persons whose usual place of residence is within an area specified in Schedule 1 to this Specification are exempt welfare payment recipients.

(2)        In Schedule 1, an area has the same meaning as in the Local Government Act 1993 (NSW).

5              Exempt class - Queensland

(1)        For subsection 123UGB(2) of the Act, the class of persons whose usual place of residence is within a local government area specified in Schedule 2 to this Specification are exempt welfare payment recipients.

(2)        In Schedule 2, a local government area has the same meaning as in the Local Government Act 2009 (QLD).

6              Exempt class – South Australia

(1)        For subsection 123UGB(2) of the Act, the class of persons whose usual place of residence is within an area of a council specified in Schedule 3 to this Specification are exempt welfare payment recipients.

(2)        In Schedule 3, an area of a council has the same meaning as in the Local Government Act 1999 (SA).

7              Exempt class - Victoria

(1)        For subsection 123UGB(2) of the Act, the class of persons whose usual place of residence is within a municipal district specified in Schedule 4 to this Specification are exempt welfare payment recipients.

(2)        In Schedule 4, a municipal district has the same meaning as in the Local Government Act 1989 (VIC).
