These rules amend the Torres Strait Regional Authority Election Rules 1996. The Aboriginal and Torres Strait Islander Act 2005 which came into effect on 5 November 2011 removed the connection between Queensland local government legislation and the appointment of TSRA members with the intention that from the forthcoming TSRA election, all TSRA members would be directly elected under the Rules. Amendments to the Torres Strait Regional Authority Election Rules 1996 are consequently required to create new wards to allow for direct election of all members.

I, Jenny Macklin, Minister for Families, Community Services and Indigenous Affairs, make the following rule under section 143G of the Aboriginal and Torres Strait Islander Act 2005.

1              Name of rule

                This rule is the Torres Strait Regional Authority Election Amendment Rule 2012 (No. 1).

2              Commencement

                This rule commences on the day after it is registered.

3              Amendment of Torres Strait Regional Authority Election Rules 1996

                Schedule 1 amends the Torres Strait Regional Authority Election Rules 1996.

                (e)    the Erub Island ward;

                (f)    the Hammond Island ward;

               (g)    the Iama Island ward;

               (h)    the Kubin ward;

                (i)    the Mabuiag Island ward;

                (j)    the Masig Island ward;

               (k)    the Mer Island ward;

                (l)    the Ngurapai and Muralag ward;

              (m)    the Port Kennedy ward;

               (n)    the Poruma Island ward;

               (o)    the Saibai Island ward;

               (p)    the Seisia ward;

               (q)    the St Pauls ward;

                (r)    the TRAWQ ward;

                (s)    the Ugar Island ward;

                (t)    the Warraber Island ward.

                For paragraph 142TA (1) (b) of the Act, this rule sets the boundaries for the TSRA wards mentioned in rule 2A.

                The following provisions are amended by omitting ‘Authority’ and inserting ‘TSRA’:

                   ·     subparagraph 4 (2) (d) (ii)

                   ·     rules 6 and 8

                   ·     subparagraphs 31 (1) (e) (ii) and 44 (3) (e) (ii)

                   ·     paragraph 118 (1) (j).
