Environment Protection and Biodiversity Conservation Act 1999 (Cth)

 

Instrument to remove a Commonwealth Heritage place and its Commonwealth heritage values from the Commonwealth Heritage List

 

 

I, Tony Burke, Minister for Sustainability, Environment, Water, Population and Communities,

 

·                   being satisfied that the Commonwealth Heritage place, described in Schedule B (Thornton Hall & Surrounds), no longer has the Commonwealth Heritage values identified in column 1 of the Table in Schedule A (the heritage values); and

·                   having considered the advice of the Australian Heritage Council on the proposed removal of Thornton Hall & Surrounds and its heritage values from the Commonwealth Heritage List; and

·                   having called for public comments on the proposed removal of Thornton Hall & Surrounds and its heritage values from the Commonwealth Heritage List and noting no public comments were received,

 

pursuant to section 341L(2)(a) of the Environment Protection and Biodiversity Conservation Act 1999 (Cth) (the Act), remove Thornton Hall & Surrounds and its heritage values from the Commonwealth Heritage List.

 

This Instrument commences on the first day on which it is no longer liable to be disallowed, or to be taken to have been disallowed, under the Legislative Instruments Act 2003 (Cth).

Schedule A

 

 

 

Thornton Hall & Surrounds is not considered to meet the Commonwealth Heritage criteria for the values indicated in column 1 of the following table for the reasons given in column 2 of the table:

Schedule B

 

Thornton Hall & Surrounds

 

About 4ha, 11 Mountain View Crescent, Penrith, comprising the area known as the Defence Multi-User Depot now known as the Penrith Training Depot (Lot 10 in DP1159973) which remains a Commonwealth area.

 

The following area was sold and is no longer Commonwealth land and as a consequence has been removed from the Commonwealth Heritage List:

Within DP 33753, and DP 33754, the area comprises:

  • former Thornton Hall, 11 Mountain View Crescent, and part Army Reserve 5th Field Squadron, The Crescent, Penrith.
  • The area is bounded by a line that commences:
    •  at the intersection of Mountain View Crescent and The Crescent, then
    •  via the centreline of Mountain View Crescent, and the centreline of the alignment of that part of Mountain View Crescent that is parallel to Lemon Grove Road, to the Army Reserve boundary,
    • then north westerly via the north-eastern boundary of the Army Reserve and the initial alignment of that boundary
    • to its intersection with the alignment of a road that extends north easterly from the centre of the reserve oval (approximate AMG point 287050mE 6263290mN),
    • then south westerly via that alignment and road to the road on the north eastern side of the reserve oval,
    • then north westerly via that road to the road that bounds the north western side of the oval,
    • then south westerly via that road to the road that bounds the south western side of the oval at approximate AMG point 286660mE 6263240mN,
    • then south easterly via that road and its alignment to its intersection with the Army Reserve boundary,
    • then easterly via that boundary to the point of commencement.
