Information provided by general insurers and Lloyd’s underwriters for the purposes of the National Claims and Policies Database under Reporting Standard GRS 800.1, GRS 800.2, GRS 800.3, LOLRS 800.1 LOLRS 800.2 and LOLRS 800.3.

 

Australian Prudential Regulation Authority Act 1998

 

 

I, Juanita Hoare, a delegate of APRA, under section 57 of the Australian Prudential

Regulation Authority Act 1998, DETERMINE that a reporting document described in Part 1

of the Schedule does not contain confidential information, except for the items of information specified in Part 2 of the Schedule.

 

This determination has effect on the date of registration on the Federal Register of Legislative Instruments under the Legislative Instruments Act 2003.

 

Note:            The effect of this determination is that the non-confidential information may be published under subsection 56(5C) of the Australian Prudential Regulation Authority Act.

reporting document means a reporting document within the meaning of section 13 of the Financial Sector (Collection of Data) Act 2001.


Schedule

 

Part 1 (reporting documents covered by this determination)

 

 

 

 

In this Schedule:

general insurer has the meaning given in section 11 of the Insurance Act 1973.

Lloyd’s underwriter has the meaning given in section 3 of the Insurance Act 1973.

reporting standards means any or all of the following reporting standards made under the Financial Sector (Collection of Data) Act 2001:

 

  • Reporting Standard GRS 800.1 Policy Data: Public and Product Liability and Professional Indemnity Insurance;

 

 

  • Reporting Standard GRS 800.2 Claims Data: Public and Product Liability and Professional Indemnity Insurance;

 

 

  • Reporting Standard GRS 800.3 Facility Business Data: Public and Product Liability

and Professional Indemnity Insurance;

 

 

  • Reporting Standard LOLRS 800.1 Policy Data: Public and Product Liability and Professional Indemnity Insurance;

 

 

  • Reporting Standard LOLRS 800.2 Claims Data: Public and Product Liability and Professional Indemnity Insurance; and

 

 

  • Reporting Standard LOLRS 800.3 Facility Business Data: Public and Product Liability and Professional Indemnity Insurance.

 

 

This determination covers information in a reporting document given to APRA under the reporting standards on or before the date of this determination by a general insurer or Lloyd’s underwriter, where the information satisfies all of the following conditions:

 

  1. The information is one of the following types of data measures: gross written premium; gross earned premium; number of risks written; average written premium; number of claims reported; number of claims finalised; gross claim payments; gross claims incurred; premiums received; claims paid; number of policies; number of claims; number of facilities.

 

 

  1. Subject to condition 3, the information is aggregated by cross-tabulating across all of

the following types of data dimensions: year; development year; class of business; state/jurisdiction; product; industry/occupation; limit of indemnity; excess/deductible.

 

Each data dimension is expressed as one of the following values:

 

a)      year as: underwriting year; accident year; calendar year; or six month reporting period (facility reports only);

 

b)      development year as: all; or a value from 0 to 9;

 

c)      class of business as: professional indemnity; or public and product liability;

 

d)     state/jurisdiction as: all States;  NSW; VIC;  QLD;  SA;  WA;  TAS;  NT; ACT; or unknown;

 

e)      product as: all; directors’ and officers’ and employment practices liability;

medical indemnity/malpractice; other professional indemnity; construction

liability; product liability; public liability; or other product and public liability;

 

f)       industry/occupation as: all; 2 digit Australian and New Zealand Standard

Industrial Classification code; or 1 character occupation code of A – financial occupations, B – general consultants, C – medical and & paramedical

occupations, D – legal & para legal occupations, E – real estate occupations, F

– agricultural, horticultural occupations, G – schools, colleges occupations, H

– insurance occupations, I – local government occupations, J – miscellaneous occupations, K – architects, L – engineering occupations, M – surveying occupations, or N – defamation;

 

g)      limit of indemnity (LOI) as: all; $0 - $5 million; $5 million - $10 million; or

$10 million or more; and

 

h)      excess/deductible as: all; $0 - $499, $500 - $999; or $1,000 or more.

 

3.      The information is not aggregated by cross-tabulating the following data dimensions:

 

 

a)      an occupation data dimension (other than “all”) and any of the following state/jurisdiction data dimensions: NSW, VIC, QLD, SA, WA, TAS, NT,

ACT, unknown; or

 

b)      any of the following LOI data dimensions $0 - $5 million; $5 million - $10

million; or $10 million or more and any of the following excess/deductible

data dimensions $0 - $499, $500 - $999; or $1,000 or more.
