1.               Name of Determination

This Determination is the Health Insurance (Cone Beam Computed Tomography) Determination 2011.

2.               Commencement

This Determination commences on 1 July 2011. 

3.               Interpretation

(1)        In this Determination:

cone beam computed tomography means a service performed:

(a)                    using a detector coupled to an x-ray tube that emits a volumetric x-ray beam as it rotates within a gantry around a patient: and

(b)                   registering a resulting variable amount of x-rays and transforming that information into a cross-sectional image after the application of complex algorithms.

relevant provisions means all provisions, relating to professional services or to medical services, of the Act and regulations made under the Act, and the National Health Act 1953 and regulations made under that Act.

relevant service means a health service, as defined in subsection 3C(8) of the Act, that is specified in the Schedule.

the Act means the Health Insurance Act 1973.

the Schedule means the Schedule to this Determination.

Note          Unless the contrary intention appears, expressions used in this Determination have the same meanings as in the Act—see section 13 of the Legislative Instruments Act 2003.

(2)        Unless the contrary intention appears, a reference in this Determination to a provision of the Act or the National Health Act 1953 or regulations made under the Act or under the National Health Act 1953 as applied, adopted or incorporated in relation to specifying a matter is a reference to those provisions as in force from time to time and any other reference to provisions of an Act or regulations is a reference to those provisions as in force from time to time.

4.               Treatment of a relevant service

Subject to section 5, a relevant service provided in accordance with this Determination is to be treated, for the relevant provisions, as if:

(a)                    it were both a professional service and a medical service; and

(b)                   there were an item in Group I2 of the Health Insurance (Diagnostic Imaging Services Table) Regulations 2010 that:

i.                related to the service; and

ii.             specified for the service a fee in relation to each State, being the fee specified in the Schedule in relation to the service; and

(c)                    the items referred to in the Schedule were also specified as items in Group I2 of Division 2.2 of Schedule 1 Part 2 of the Health Insurance (Diagnostic Imaging Services Table) Regulations 2010 as in force from time to time;

(d)                   for the purposes of subsection 16B(2) of the Act, the items referred to in the Schedule to this Determination were specified in Regulation 10(1)(e) of the Health Insurance Regulations 1975.

5.            Exclusion of accreditation requirements

 The relevant services specified in the Schedule are not subject to:

(a)    section 16EA of the Act;

(b)   Division 5 of Part IIB of the Act; or

(c)    regulation 20B(2) of the Health Insurance Regulations 1975.
