Education Services for Overseas Students Act 2000

 

 

Specification of criteria for the purposes of the definition of designated authority under

section 5 of the Education Services for Overseas Students Act 2000 (the ESOS Act)

 

 

I, Chris Evans, Minister for Tertiary Education, Skills, Jobs and Workplace Relations, for the purpose of paragraph (b) of the definition of designated authority under section 5 of the ESOS Act, determine that, to the extent that the provider provides an English Language Intensive Course for Overseas Students, a Foundation Program, or both, the designated authority for a State, in relation to a provider, is:

 

  1. the Australian Skills Quality Authority (ASQA) except in the case where the provider of the English Language Intensive Course for Overseas Students, a Foundation Program, or both is a primary school or secondary school in a State, which is not a registered training organisation for the purposes of the National Vocational Education and Training Regulator Act 2011;

 

  1. the person responsible under the law of the State for approving providers to provide courses to overseas students for the State in the case where the provider is a primary school or secondary school in a State, which is not a registered training organisation for the purposes of the National Vocational Education and Training Regulator Act 2011.

1                      CITATION

 

This legislative instrument may be cited as the Specification of criteria for the purposes of the definition of “designated authority”.

 

 

2                      AUTHORITY

 

This legislative instrument is made under paragraph (b) of the definition of designated authority in section 5 of the Education Services for Overseas Students Act 2000 (the ESOS Act).

 

 

3                      DATE OF EFFECT

 

This legislative instrument commences on 1 July 2011.
