This Notice will make NBN Co Limited a Commonwealth authority for the purposes of the Safety, Rehabilitation and Compensation Act 1988. NBN Co Limited is a company limited by guarantee, incorporated under the Corporations Act 2001 with the Commonwealth as its sole member. Therefore NBN Co Limited satisfies the criteria required for a declaration to be made under paragraph (c) of the definition of ‘Commonwealth authority’.

General Comments: This instrument is also taken to be made under the Safety, Rehabilitation and Compensation (Defence-related Claims) Act 1988 (the DRCA), by virtue of transitional provisions in the Safety, Rehabilitation and Compensation Legislation Amendment (Defence Force) Act 2017. The Minster for Veterans’ Affairs is responsible for administering the DRCA.

I, CHRIS EVANS, Minister for Tertiary Education, Skills, Jobs and Workplace Relations, make this Notice under subsection 4(1) of the Safety, Rehabilitation and Compensation Act 1988.

1              Name of Notice

                This Notice is the Safety, Rehabilitation and Compensation (Commonwealth Authority) Notice 2011 (1).

2              Commencement

                This Notice commences on 1 July 2011. 

3              Declaration

For the purposes of subsection 4(1) of the Safety, Rehabilitation and Compensation Act 1988 (the Act) in relation to the definition of Commonwealth authority, I declare that under paragraph (c) of that definition that NBN Co Limited (ACN 136 533 741) is a body corporate to which the Act applies.
