I, PROFESSOR MARIE BASHIR, AC, CVO, Administrator of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Energy Efficiency Opportunities Act 2006.

1              Name of Regulations

                These Regulations are the Energy Efficiency Opportunities Amendment Regulations 2011 (No. 1).

2              Commencement

                These Regulations commence on 1 July 2011.

3              Amendment of Energy Efficiency Opportunities Regulations 2006

                Schedule 1 amends the Energy Efficiency Opportunities Regulations 2006.


Schedule 1        Amendments

(regulation 3)

 

[1]           Paragraphs 2.1 (2) (a) and (b)

substitute

                (a)    whose main business is:

                          (i)    the transmission of either or both of natural gas and electricity; or

                         (ii)    the distribution of either or both of natural gas and electricity; or

                        (iii)    the transmission and distribution of either or both of natural gas and electricity; and

               (b)    for which the total energy used in its activities (other than the transmission and distribution of natural gas and electricity) does not exceed 0.5 PJ in a year; and

[2]           Paragraphs 2.2 (2) (b) and (c)

substitute

               (b)    whose main business is:

                          (i)    the transmission of either or both of natural gas and electricity; or

                         (ii)    the distribution of either or both of natural gas and electricity; or

                        (iii)    the transmission and distribution of either or both of natural gas and electricity; and            

                (c)    for which the total energy used in its activities (other than the transmission and distribution of natural gas and electricity) does not exceed 0.5 PJ in a year; and
