This Class Order makes minor variations to ASIC Class Order [CO 09/425] to allow entities that take advantage of [CO 05/644], [CO 06/441] and [CO 10/654] to be provided with conditional relief from certain provisions in Ch 6D and Part 7.9 of the Act in relation to the offering of share and interest purchase plans.

Enabling legislation

 

1.       The Australian Securities and Investments Commission makes this instrument under subsections 741(1) and 1020F(1) of the Corporations Act 2001.

 

Title

 

2.       This instrument is ASIC Class Order [CO 11/162].

 

Commencement

 

3.       This instrument commences on the date it is registered under the Legislative Instruments Act 2003.

Variation

 

4.       ASIC Class Order [CO 09/425] is varied by, in subparagraph 14(a), in the definition of excluded order, omitting “[CO 05/644] and [CO 06/441].” and substituting “[CO 05/644], [CO 06/441] and [CO 10/654].”.
